It is similar to the one found on other postings, but I will include it here. I changed it for PDM simply because the law in AZ changed after June 30, 2010 and my loan with them was issued after that.
To whom it may concern:
This letter is to inform you that I am aware of the fact that the loan which was issued to me is not legally binding in the state Arizona. I am bound by the state laws where I reside. As I have no presence in your state, I therefore have no legal obligation to the 'governing laws' you may have detailed.
Prior to July 1, 2010, the state of Arizona required Internet payday lenders to be licensed in the state in order to be a lender. As of July 1, 2010, however, payday loans are illegal in the state of Arizona. (Please see attached letter from Arizona Attorney General Terry Goddard) My loan contract was executed on July 8, 2010 and is therefore illegal and void.
Effective immediately, I hereby revoke any and all ACH authorizations with your company from debiting any and all of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I also revoke any and all wage assignments I may have signed, by you, including but not limited to; any of your affiliates, dba's, and collection agencies assigned to this account. I further request that any future communication regarding my account be conducted by email and that I nor my employer or references not be contacted by phone.
My financial records indicate that I received a loan in the amount of $300.00 and have paid, to date, $245.51. Because the terms of the loan violated Arizona state law, I am only responsible for the principal amount funded and would happily make arrangements to forward the remaining $54.49 via Western Union or some other form of payment after which I expect my account to be considered paid in full. If you are unable or unwilling to comply with my request, I will be forced to file complaints with the Office of the Arizona Attorney General, the BBB and the Federal Trade Commission. Please respond via email within 2 business days.
