Payday loan and unemployment

I have a question regarding the fact that I have been layed off (temporary) and want to know how to handle payday loans. I have had to file for unemployment benefits and I have the paperwork to show this, I also have a letter from the Texas workforce commission showing that I am entitled to unemployment, and what I am eligible for. I am in the process of closing down my checking account based on the fact that there payday loans that I have are illegal. Has any one dealt with payday lenders and working out payments plans with them since I am now unemployed. Unemployment may be a blessing, since the payday loans are based on employment and regular income. Has anybody dealt with this situation, what would be the appropriate steps? I am going to start calling to inform them that I am not employed, and would like to know what I may be up against. I want to know how to approach this with them before I start even if it just buys me some time. Any thoughts or suggestions, I need to pay my bills with my unemployement not payday lenders. Please advise. I am still on the books with my unemployer, but because there are no available hours for me to bill against, I am technically unemployed, My benefits are issued on a state debit card, no direct deposit to checking account.

I am not trying to avoid paying them, I will pay what I borrowed, but I cannot pay them now because of the unemployment. I am still closing my account, and sending the letters, would have done that anyway. I didn't say it was an excuse either, it is just the truth, I just wanted to know if anyone has dealt with this. Regardless, i was an idiot now I know this, I am trying to honor my obligation to the extent that I am required by law. Bottom line is they cannot get what I dont have Right. No account access, no job, no money.

If they say they cant then I am going to let them know that I am aware that they are illegal, and that I will be involving the AG and the OCC. I will be closing my checking account today. Oh I am also going to record the conversation when I speak with them as they record customers for " for training purposes" I will let you know as I work through my internet pdls. If nothing more there it will mess with the scum sucking bottom feeding lower than whale poop illegal entities. and it makes me feel not so bad about being an idiot in pdl hell.

on my way to the bank, I went to the bank and missed the branch manager I will be there when they open in the morning. I have opened a new account with a credit union so I have a place to put my money now. My checking account now is over drawn 1600.00, I know that I am going to have to bring that to positive bal before I can close the account. I just need to make sure that during that process that the don't allow any ach's to go through. I also will have no money going in because of my unemployment. In the interim i did find some information on IBC bank. They have complaints against them. One thing I noticed that on some of the complaints at the rippoff report, the bank was also reported to the FDIC along with the AG and OCCC in texas. I never thought of doing that. I thought that was and excellent idea. and in all cases the customer was refunded by the bank so it seems. I was really disappointed to see this with this bank as I have been doing business with them for over 10 years. Does anyone have ideas about reporting banks to the FDIC as well.

Just a thought. I am going to do a little research on this. IBC mainly deals in TX and OK. So this might be of benefit to people in OK.

Once you have your list together, carefully check the amounts that you actually owe the illegal lenders. If you've overpaid them, you need to go to your bank and let them know the ACHs made after payment in full were unauthorized. You can simply tell them the truth. This was for a loan, I was required to pay back $x but they kept taking payments after the account was PIF. They will reverse the charges and should also refund OD fees that were caused by the transaction. That could help you a bit with the amount your account is overdrawn.

For the record, I will say CashNet USA, Payday One, Speedy Cash Online, and Check N Go have been very understanding. I explained the unemployment situation, told them what I was able to do and when. Now Cash Central actually indicated that I needed to commit fraud, inorder to work out a payment plan with them. I indicated that I would not, the guy on the phone, the supervisor name is Dustin, said he could only adjust my payday two days, and the only way that I could get a EPP with them was to let the check bounce, knowing the money is not in there I told him I would not be gettin direct deposit, and he went down this really long list of options, like borrow from my 401K, small loan from my bank, yadda yadda yadda. I told him, that If I could do that..... I would n't need a damn payday loan. Unbelieveable. Needless to say I got till Monday to figure out how I am going to pay them...... In the mean time, I have found the owners, name, the Managers name, The CEOs Name, and phone numbers, I will attempt to call them to morrow. They kept insisting that the only way to work out a payment plan is to default. That is Fraud! I looked on there website and found that they are part of a lobbiest group called Online Lenders Alliance out of Washington DC, dug a little more and it directed me to the consumers Best Practice thingy, I guess it is similar to CFSAs deal. I will be filing a complaint with them as well. I am also going to file a complaint with UTAH , Just in case they try to say I am subject to Utah law not Texas, even thought the do business with Texas as a CSO. It says that I can request EPP, min of 4 payments, for not less than 60 days. no interest. I am really fired up with this one.

Has anyone dealt with the Online Lenders Alliance. org? Sorry so long.

Ok update , Go a payment Hold with Check and Go, and Check go sait that I have to bounce a check to get payment arrangments. I told them that this was fraud, if I knowingly called in advance, to tell them there is no money in the account, sent the a copy of of my unemployemnt letter, and they said that this didnt matter because in Texas I can get 7 refinances. The point was to make a payment on the princpal bal in and extended plan because i was not getting a paycheck and it is not direct deposited. i will be calling the corporte offices to morrow. Already logged complaints with the BBB, Texas AG, OCCS, FDIC, FTC and FBI, and the I was not trying to not pay my bill, i needed to not commit fraud. the will not give EPP, because I am in Texas. When I spoke with the OCCC office, submitted complaint over the phone she said What? you did the right thing, I also informed her that I would be reporting them to UTAH in accordance with the PD laws there. I am sure it won't go anywhere with them, but just in case they say I have to follow the laws in UTAH, well they will already know. I have and arrangement in writing with PDO, Cash NET USA, and even two of the damned illegal ones, They were understanding once I told them I was unemployed, and offer to provide them my aproval for Unemloyment benefits from the STATE OF TEXAS.. We are known, to raise a little hell down here yall. :-). going to the bank to finalized the closing of account, armed with my handy dandy lil law book, on padloans in texas, legal and illegal, and letters of revocation, copies of complaints to all appropriate offices. I have a call in to the local tv station that I have a story that may interest him.... He has been phenominal in getting results... He got our HOA fired. and that as you may know is virtually inpossible. I am gonna kick the cooks out of Texas... If I can..
