Question on way CA handles debt

I was sitting here reading the posts this morning and got curious about something. Why does these collection agencies feel they need to threaten to people processed, charging with check fraud, going to jail and better retain an attorney? Don't they realize we are all going to fight back? I am just curious?


Hey Brat! The only thing I can come up with, is that, no they don't know. They are so used to dealing with people who are 'scared' of them. They snap their fingers and debtors run down to the western union because they told us that if they didn't get the money in ten minutes, they were coming after our first born. They count on this, this is how they operate. There are some people that are educated like us, but they're willing to take the chance that we're not. make sense? Most people don't know any better, they don't realize that they have rights. Shirley

The reason CA's do this kind of stuff is because no one makes complaints against them, because they are afraid. That is why if you look up some of these 'bad' companies everyone is complaining about, you will find that the BBB says they have satisfactory record. People think that because they owe the money, that making any complaints against them will result in retaliation that they cannot afford.

Another reason I think, and this is just my opinion, is the type of people that a lot of (not all) collectors are...they are in it for the money and have no regard for other human beings and their problems. If these collectors were not working primarily on commission, these problems would not occur...but on the flip-side, if they were not working on commission, the companies they collect for know they would not try as hard to collect the debt, which I am sure is true.

Fear is the factor that kills most of the people. If a person is not aware of the debt, he will make arrangements in panic when contacted by these agencies. Some of us get scared to death when these CAs threaten with legal actions. We fail to exercise our legal rights at such times and the company preys on such people for stealing money.

I was among the few people who was afraid to take any call from the collection and was not aware of the legal powers assigned to me. I was not known to the debt validation procedure and recording of the phone call. But now, I am suggesting people so that they do not have to go through the same situation as I went through.

I was just curious. My mom received a call from a collection agency. They had her so scared Saturday morning, she was crying when she called me and I told her to calm down and think through what they said and hit them with a debt validation and cease communication letter. After talking to her for about an hour, I thought she was all calmed down, then about 10:30 saturday night, my step dad called and said mom was on her way to the hospital. When he called back Sunday morning, he said she had a heart attack. I hope these collection agencies are proud of their accomplishments.

brat-4-ever- I am really sorry to hear about that. That is horrible. I think maybe your mother needs to unplug her phone for a while. The added stress is not going to help her at all. And now with this hospital visit, I am sure there will be more bills to come. I hope she has insurance. If there are any bills left over for the hospital make sure you talk to the hospital about financial aid....if she doesn't have money to pay, a lot of hospitals have programs to write off or reduce the balance that the patient has. Hope she is doing well.

I am sad to hear about your mother. These CAs are just jerks and they really don't have a heart. I just don't have words to say on such people who don't have a life. They know that they are violating the laws but still they continue with it. Let's all combine together and file a class action lawsuit. We need to take such steps otherwise we will see many of our close ones in pain!!

Just thought I would update. My step dad called last night and mom is doing a little better and they moved her to a private room. He called the phone company and changed their home phone number and had it unpublished. Like he said, it will cost a little more, but its not worth having to bury his wife because of the harassment they have received. He was going to spend today looking for an attorney that handles cases like this.
