Capital One will very definitely sue if you do not settle with them. They never offered me a chance to settle before sending my suit to a law firm in my state. They would only settle for 15% off the balance and wavier of attorney's fees.
It's in your best interest not to wait that long. If I had known anything about default, I wouldn't have, but I had never before been in a position where I couldn't pay my credit card bills.

Oh they do not mess around! I was sent to collections for a $500 balance and was sued within 4 months. I was able to make payment arrangements with the attorney BUT they continued with the court case and I had to go and prove that I was paying.

Due to unforeseen circumstances, I defaulted on my Capital One card. I owed $940. They turned it over to an attorney in my State within 4 months. I was able to settle with the attorney at 80% ($752) prior to them filing a lawsuit. The attorney allowed me to pay this over 3-months. It worked out for me and although it was hard to pay the $752 in a 3-month period, I sucked it up and did it. I am so glad I am done with Capital One!
