Oh yes they can. You need to file a dispute that the check was not authorized, you never approved it by phone and this company is fraudulently withdrawing funds from your account. This is exactly why we always advise that you close your account and open a new one. It's the only way your money will truly be safe. These illegal companies always find a way to get into your account once they have your info.

Wow...I cant believe a teller told you that. Go in, talk to a manager and file a fraud report.

They had to dig pretty deep to find out, but apparently it was written to a company called MD Marketing. The 877 number attached to this company was My Next Day Cash. I told the teller that was a lie. She said there wasn't anything the CU could do because the check had already cleared.... Now what. |
When I asked what I should do the teller said there wasn't anything they could do. I then asked, should I go to the police then? Because these people stole money from me! And she said that my best bet was to try to get it back from the person (company) that took it and if that didn't work then go to the police....

this is why we always advise closing that account as some places will put a paper check through, and some banks will honor it despite the block.see the manager, not a teller and file a fraud report.then get the account on deposits only.then not even their paper check can go through.

I'll "second" what others have said; go to the manager and explain the situation. If there is no physical proof that you authorized that check, I can't imagine the bank/credit union can't refund your money.

Tellers aren't trained to handle these types of transactions. I work at a bank - in the corporate offices. You can first talk to a relationship manager (or whatever your bank calls them). They're the people who actually have offices/cubes/desks at the bank. If you can't get a satisfactory answer from them, demand to speak to the branch maanger.

I went and spoke to the mgr today. She again said there wasn't anything they could do. The name of the company is My Next Day Cash. I live in Michigan. The original loan was $400 and they have taken $1315.00 from my account. According to my loan papers the amount to be paid back was $460. The person from My Next Day Cash cheerfully told me that my loan was now paid in full (big deal) except for one more payment of $160.00 but they were going to 'forgive' that payment, and that according to the contract that I signed they had authorization to present that hard check to my CU for payment. That check they wrote has wreaked havoc on my account. This company is not licensed to lend in my state. When I told her that she basically told me that I signed all rights away! They refuse to send a refund and my CU refuses to do anything about it. Now what....

AAACU wants a copy of the contract I signed. I tried to tell them just because I may have electronically signed a contract waiving my rights doesn't mean my rights are waived. I tried to explain the payday laws but they seemed uninterested in hearing them. They feel that if I signed this contract they have to honor the check.

The President/CEO of your CU is Donald J. Mills. Try contacting him directly with your complaint. This is fraud and the bank is required to deal with it. If this gets you nowhere, your next step will be to contact the Federal Reserve Bank and the Office of the Comptroller of the Currency. And I'd tell him that's your next step.

That is a total LIE. I had that happen to me, I had to sign a form stating I did not authorize them to withdraw money out of my account - I signed it and it went to the fraud dept. then the fraud dept contacted me and I told them that I revoked my ach and then they turned around and withdrew x amt of dollars. They looked at my acct. seen when the deposit was and how long I was making the payments and then for how much, added it up and then realized how much I had already paid which was way over what they deposited and then they reversed the check. They tried again right after the check was reversed with a different name but by then the acct was on deposit only so I could see it coming through but at midnight it would go right back. The CU is lying well maybe not lying but has no clue what they are doing. I'd definately call the higher up or ask for a phone number for the fraud dept. My bank said I have 90 days to contest anything posting to my account

My email to dmills just bounced back. Let me look for a correct email. If they honored your ACH revocation, why are they giving you a hard time when the same slimey company is now sending unauthorized checks? Makes no sense. Contact the president!
That is his correct email address, according to the annual report.

You need to call the Office of the Comptroller of the Currency for your area. You should also contact your closest Federal Reserve Bank and let them know that his CU is allowing these fraudulent transactions.
