So i just got a call from Fast Cash Advance who says that they are looking to collect on a payday loan that they advanced me (without my permission by the way) and now they want to collect. if i don't pay them right away they will forward over the wage assignment that I signed at the time of the loan. I have never signed anything with them. i applied for a payday loan on a web search site, i was contacted by Fast Cash Advance, they wanted me to send them my paystub and a bank statement, i forwarded the paystub, not the bank statement and had decided not to take out the loan, and then all of a sudden there was $350 in my checking account. I closed the checking account and have sent out letters to all of my other payday lenders and figured I would put them on the back burner until I was able to address them, now I have gotten this call. When I called back, they said they don't have to send me the loan disclosure that i signed, because i e-signed for it, and they are going to pass this on to their fraud dept. Again, I have never signed anything with them, not even e-signed anything, they never discussed the terms of the loan with, sent me anything with the terms of the loan or anything.......Help? What do i do?

As for the wage assignment part, it can easily be revoked. Don't pay these illegal lenders a dime more than the actual amount borrowed.

You need to send them a letter/fax/email revoking your wage assignment. It was likely part of the contract. An e-signature isn't valid on a wage assignemnt anyway and it's voluntary. You'll need to give a copy of it to your HR/Payroll department as well.

You do need to repay them the amount of money that was given to you. I would set up an arrangement with them but do not give them any account info. Send them money orders or get a prepaid debit card. I am curious. When the money showed up in your account, why didn't you just have your bank return it if you hadn't applied for the loan or changed your mind? Why immediately close the account instead?

to be honest, I don't know, I was traveling and just didn't stop to think...I should have done that, it would have been the smart thing to do. I do not have an address to send them any kind of wage assignment revocation. I don't know how they would even have a wage assignment since I have never signed anything with them ??????

fastcash-advance and paydayloanyes.....are they the same, where are they located, i thought i saw on a thread somewhere that shazzers said paydayloanyes wasn't even in the united states....on my email from them it has paydayloanyes....but when they call they say the $$ came from fastcash-advance....

It's faster and easier to shoot them an email, date it, print it out and show it to your employer because Paydayloanyes will ignore it anyway, your employer must honor your revocation. If you send it through USPS, they will probably toss it in the trash.
