I have a payday loan that is in default, I have been making patments, but they are telling me they can garnish my husbands wages if i do not pay them. Is that true? heis not on the loan.


They cannot garnish you or your husband without a court order. However, you may have signed a wage asssignment at the time you signed your loan documents. These are voluntary and can be revoked at any time. You simply need to send them a letter stating that you revoke any wage assignment you may have signed and also give a copy to your payroll department. If your husband isn't on the loan, his wages shouldn't be in jeopardy. They're just trying to scare you into paying them.
