I'm getting calls at my mom's house from a company called GCS from Arizona...not sure if it is a collection agency or not, but you know how it is when you are getting other collection calls, you are scared to answer the phone...LOL :) Any help is appreciated :)

What state do you live in? There are 35 states now that do not require you to tell the other party they are being recorded. You can ask your attorney generals office and they can tell you if your state is one of those. I live in Texas and we do not have to tell the other party we are recording.

Secretly recording a phone conversation regarding debt collection is legal in :

Quote:

Alabama, Alaska, Arizona, Arkansas, Colorado, District of Columbia, Georgia, Hawaii, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Minnesota, Mississippi, Missouri, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Rhode Island, South Carolina, Tennessee, Texas, Utah, Virginia, West Virginia, Wisconsin and Wyoming.

In the remaining states, you will have to take the permission of the other party before the call is recorded. Just make your statement clear in the recording and if the other party continues with the conversation, they have given their consent.

A lot of collectors aren't happy with being recorded, and might tell you to turn off the recorder...DO NOT DO THAT. If they continue to talk, then they are agreeing to be recorded. Just don't let them scare you, as they will try. It is funny though, because they have no problem recording you.
