Payday Loan collections in Kansas
Date: Fri, 09/17/2010 - 11:53
The Payday loan collectors are calling 5 - 6 times a day and threatening criminal prosecution. Is it a criminal offense in KS? If it is civil, what could they possibly get from this person (household items, maybe the car)? This person has lost everything to the Boats. Stupid thing to do - yes, but that is the situation. I am trying to tell them to not go do anything else, don't sign or agree to any plan or Payday loan extension. But they are pretty worried about a police officer coming up to the door anyday. The payday loans are now 30 days past due and the bank checking account has now been closed (this was done right before the Payday loan checks were presented).
This person has no $$, I paid the rent & utilities for the past month, but no more. I refuse to pay anything to the payday loan people, no matter how hard they push. Sorry for the long post.
They blowing smoke....they cannot take criminal action for a PDL

They are now going to Gamblers Anomyous, but the prospect of paying back is very slim. This person might have $100 left over each month after rent, utilities, medical bills & food. Owing a debt is a civil matter not a criminal one. What are the names of the pdl's? Were they Internet or store front lenders? If they were Internet lenders I would advise her to change her phone number.
Soaplady & Shazzers, Thanks for your replies, they will at least
Soaplady & Shazzers,
Thanks for your replies, they will at least help me calm this person regarding the comments that this is a criminal offense. In any event, this will be a long hole to get out of for this person. I suspect they will be dealing with these phone calls for several years. Right now they have no plan to pay back the $$ as there is little leftover at the end of the month. Unless & until they force some change: Rent, Utilities, Food, then medical bills are first, the Payday loan people fall at the end of the list. Given this persons circumstances, still not sure what the Payday Loan people could get even if they sued. Again thanks for your advice. Please add any more info (regading the PDL remedies / actions) from your experiences if you can. Thanks Mike
