I am searching for answers on how to help my boyfriend out. WWR sent a letter stating "Please be advised this Law frim has been retained to collect the outstanding balance due and owing on this account." How should we proceed on this. It says we have 30 days to ask for a validation. Its dated 9/16/2010. He owes 4,500 and he wants to pay but it may take him about 6 months to do so. Any words of advise is greatly appriciated right now. I am a little scared of them after what I read here.

Ask him to send a Debt Validation letter via certified mail with a return request. Let the CA validate the debt. This will give your boy friend some time to manage the funds. Remember that the CA doesn't have a particular time frame to validate the debt.

But, if the CA validate the debt, send them a Cease and Desist letter stating not to contact you anymore for the debt since they have not validate the debt.

Well they just left a VM, telling my boyfriend has to call them back today. If their letter states he has 30days to disput doesnt that give him 30 days to get his letter to them. I know I am nervous about this, I really dont have the energy for them. Been sick. Should he call them or should we just get out Validation letter out?

If he knows he owes the debt, why are you validating? Are you unsure that this CA is legitimately collecting on the debt? Are you disputing the amount they say he owes? If you know you owe the debt and that the amount is correct and you're sure this company/lawfirm/CA is legitimately collecting on behalf of the OC, then just call them back and make payment arrangements.


And yes, you have 30 days to dispute the debt but collection efforts do not stop during that 30 day period.

I am really sorry for asking so many questions on something that I should be able to understand, but Paulcahill80 you are saying he should send out the debt validation letter even though he owes the money? I am just nervous cause they are a law firm.

Jasgal, I can tell you from my experience that this CA is not a plain law firm. They are very shady. They have many complaints against them. So, ask your boy friend to send the validation letter as told by Paul Cahill. There are various CAs in the US who use the word 'law firm' in their name to mislead the customers.

OhioGal1, yes he owes it and the amount includes late fees and stuff , so I guess yes to that too. He wants to pay but we can only afford 300 a month possible more. I am worried if we tell them 300 a month they will not accept that. I just want them paid. My BF has lost his house due to the housing issues and he is the sole provider for his son, so he is not rich and is trying his best. In no way does he want to get out of paying his bills.

If you're sure the amount is correct and that he owes it, I'd skip the validation, personally. You can send it if you like but, here's what I would do:

I would send a settlement offer letter instead. I would acknowledge only that you are responding to their calls and that you would like to settle this debt for $1500. You propose to make payments of $300 for 5 consecutive months, with the first payment being made within 10 business days after you receive their signed agreement. Once all payments are made, the account will be considered paid in full and they will be required to send you a PIF letter. I would also ask them, if they are agreeable to your settlement offer, to sign and return the letter to you.

Ohiogal1: I sent the DV cause the amount seems a little high and want to make sure, but once I go through the amount I would like to settle on the balance. They received the DV by fedex signature required on 10/13, Have not heard anything back since then. A little nervous since they seem to be so shady with others. I also faxed and emailed copies of the letter with proof from fedex it was received. Are they held to a timeline to get the information to me? I am starting to save as much as I can so if I hear from them I will a up front payment....

not if you sent the DV letter CMRRR.which it sounds like you did.btw you can dispute any part of the debt.it is your right.

i would sit tight.see what they do next.remember anything but the validation,or information you requested is continued collection activity.adopt a wait and see for now.

Jasgal: I had a credit card (Capital One) that went to Weltman, Weinberg & Reis. From reading your post, first you need to take a deep breath and relax. Weltman was not that difficult to deal with but it took some time. It took 5 months, but I was able to settle my account for far less than what I owed. The only thing is, they would not accept a payment plan, I had to pay the agreed settlement amount in full within 10 days. I would highly suggest that you start saving all the money you can, be patient, and wait for them to contact you, then being negotiations. When you talk with them, don't appear anxious or nervous.
