Payday Loan Yes - email response help

We did not solicit your business. You went outside of your state and took
the loan. Please reference your loan contract, the Loan Note & Disclosure
Statement, the Governing Law section. Listed below is what you agreed to /
authorized when you e-signed your loan contract. Your email does not forgive
your debt nor will it deflect further collection actions on your loan
accounts.

"Both parties agree that this Note and your account shall be governed by all
applicable federal laws and all laws of the jurisdiction in which the LENDER
is located, regardless of which state you may reside, and by signing below
or by your electronic signature, you consent to the exclusive exercise of
regulatory and ad judicatory authority by the jurisdiction in which the
Lender is located over all matters related to the Note and your account,
forsaking any jurisdiction which either party may claim by virtue of its
residency".
This is a loan payoff, meaning once you confirm this payoff by providing
your card information (see payment instructions), your account will then be
removed from the collections process, your balance will be frozen and no
further charges will be assessed on the loan balance as long as you follow
through with the agreed arrangement.
As of today, your total account balance is due $590; loan payoff is for $400
payment arrangements are for two (2) payments $200 due on 09-24-10 and
10-08-10, this will close your loan account. Payment method is Visa or
MasterCard debit/credit only. See your payment instructions listed below.

Send the PDL company a letter stating that if they don't send you the refund and the PIF within a certain period of time (stated by you) you'll file cases against them.

I appreciate your prompt response, however, your email is not the required payment confirmation. To take advantage of the loan payoff you will need to email back today your complete payment authorization, which you will find listed below in my original email. Once you have done that I will then be able to freeze your account balance and remove you from further collection actions.
Be advised that we will use the laws within your state to collect any and all monies due and you will be responsible for any and all reasonable processing fees.

I would simply respond with the fact that you are re-requesting that your account be marked as PIF and you would like a refund of the overpayment you've already made on the loan. Tell them you do NOT accept their payoff agreement as you have already paid the account in full. Have you filed your complaints with the BBB, FTC and state's AG?

it is up to you.PDLY is one of the worst illegal loans out there.besides filing the complaints you have file an FTC comlaint as well.as a matter of fact i wouldn't. your AG will let them know of the complaint by contacting them.i would let PDLY know that any further emails will be forwarded as part of that complaint.
