Hello. I have 4 pay day loans and I emailed them the letter template formating it to CT. I received two e-mails, one from CMG funding and the other one from VCFunding. Both of them wrote that I was obligated to pay them because the contract says that the legal reprucursions will be based on their location. Would someone please help me understand something. If OSL marketing is based in Nevis, West Indies, can I be sued internationally and go to jail? or can I sued in another state and go to jail?

Please Help

Don't worry guest, you cannot be sued for PDLs. And the most important thing is all PDLs are illegal in the state of Connecticut. Send letters/emails/fax to these illegal lenders stating that you will only pay the principal amount borrowed since they are illegal.

Whatever has been told to you by the PDL companies are usual misleading statements that they use to scare consumers. Don't pay heed to them. Moreover, tell them that if they don't comply to your mails, you will file cases against them with the BBB, the FTC, your states' AG and the Connecticut Department of Banking.

First of all, calm down. You can't go to jail for not paying a payday loan. Are these all internet loans? Internet payday loans are illegal in CT. If they're out of the country, they're usually illegal. How much did you borrow from each of these companies? How much have you paid back? What are the names of the companies? You said you have 4 but only mentioned CMG and VCFunding.

It sounds like you already sent them the illegal lender letters and they're responding by trying to scare you into paying. Your state law is what matters here, not the law wherever they are.

These companies are completely shameless; they use official-sounding names for their agencies (and collectors), and lots of pseudo-legal jargon to scare people. They're not going to come after you from the West Indies to collect a PDL, please don't worry on that point! I had one PDL (in India) say that they were going to come after me, I told them I'd be waiting for them! Do what paulcahill and ohiogal said, send those letters and try not to worry about those bogus telephone calls. (have you closed your checking account yet? If not, please look at the "sticky" on this site re. closing accounts and make sure they can't go after any more money)

Maria - contact the CT Dept. of Banking. I also live in CT and when I stopped overpaying a PDL and they harrassed me I sent a complaint the CT dept of banking. They sent a letter to this outfit (PDL Yes) and I haven't heard from them since. They will require a correct mailing address. PDL's are illegal in CT and the dept. of banking helped me out big time. They even sent a copy of the CT PDL laws which I have copied and sent to all my PDLs and have NOTHING. Send them a complaint - you can do it online and it is completely annomous!!!
