NH Payday Loan Help!

I have several payday loans that are causing me to slowly drown in debt. After reading some information on this site it seems to me that unless the company is licensed in NH (where I reside) they are not legal. Is this correct?

If I call the companies and state that are they likely to provide me wiht paid in full letters or should I only be communicating with them through email/physical letter?

First, I'd recommend registering so that we can better identify your posts. Second, we need more information, besides knowing that you live in NH, who are the loans with, are they storefront or internet, how much did they each deposit and how much have they withdrawn?

The loans are as follows:

Alpine Direct - Loan: 200 Withdrawn: 480
SSM Group LLC - Loan:250 Withdrawn: 600

They were all internet loans.

All the PDL companies are illegal. You are legally bound to pay only the actual amount borrowed from them. So, it seems that you actually owe refund from most of them. As for your query on whether you should call or not, I would rather advise you to communicate only through emails.

THanks so mcuh for your help. I just sent an email to the State of NH Banking Department asking whether an internet lender had to be licensed in NH to lend to NH consumers and got this response:

Did you read the section that she mentioned? I clearly says that they need to obtain a license from the commissioner.

399-A:2 License Required. –
I. No person shall engage in the business of making small loans, title loans, or payday loans in this state or with consumers located in this state, without first obtaining a license from the commissioner as provided in this chapter.
II. Each such license shall terminate on December 31st. Each license shall remain in full force and effect until surrendered, revoked, suspended, or terminated.
III. This chapter shall not apply to any person lawfully engaged in business as permitted by the laws of this state or of the United States relative to banks, trust companies, insurance companies, savings or building and loan associations, or credit unions, or to loans made by them, or to any other person not within the intent of this chapter as the commissioner may designate by rule or order, nor shall this chapter apply to any person engaged solely in the business of making loans for educational purposes or to the loans made by such persons.
IV. Any person not exempt under paragraph III, and the several members, officers, directors, agents and employees thereof, who shall willfully violate or participate in the violation of any provisions of paragraph I shall be guilty of a misdemeanor if a natural person, or guilty of a felony if any other person. If in the making or collection of a loan the person violates paragraph I of this section, the loan contract shall be void and the lender shall have no right to collect, receive, or retain any principal, interest, or charges whatsoever.
V. Any person who willfully violates any provisions of RSA 399-A:8-a, I or II or a cease and desist order or injunction issued pursuant to RSA 399-A:8 shall be guilty of a class B felony. Each of the acts specified shall constitute a separate offense and a prosecution or conviction for any one of such offenses shall not bar prosecution or conviction of any other offense.
VI. The provisions of this chapter shall apply to any person who seeks to evade its application by any device, subterfuge, or pretense, including, without limitation:
(a) Calling a loan by any other name;
(b) Using any agents, affiliates, or subsidiaries in an attempt to avoid the application of the provisions of this chapter; or
(c) Having any affiliation or other business arrangement with an entity that is exempt from the provisions of this chapter, the effect of which is to evade the provisions of this chapter, including, without limitation, making a loan, while purporting to be the agent of such an exempt entity where the purported agent holds, acquires, or maintains a preponderant economic interest in the revenues generated by the loan.

Just a quick update for anyone that is interested:

Alpine stated through the BBB they would consider my account paid in full. I still pushed for a refund but no reponse yet.
SSM Group, LLC provided me with a 350 refund.
VIP Loan Shop has been brutal...but I havent heard anything from them in a couple weeks.
CCS provided me with a 165 refund
Payday Services did not respond to the BBB complaint..and I have heard nothing from them.
Cash In A Wink considered my account closed and paid in full.
Extra Cash Live I have not heard anythign back from them
Big Sky Cash continues to harass me however the NH State Banking Department has let me know that they are investigating them currently..hopefully it will result in a cease and desist.
Ace Cash Services has not responded to any emails but i have also not heard anything from them.
East Side Lenders has been brutal. They responded to my BBB complaint that they are legal in the state of delaware therefore my debt is valid. They harass me by phone and email and I am not even sure of how to move forward with that one.

All in all it has been a long process and so far I have only recieved word that I am considered pif with two, and recieved refunds from 2. Still a long ways to go...

Stay tough! You are doing great. I started with 8 internet loans and 2 storefront. As of today, I have successfully paid 2 internet (legal in my state), 6 not legal (I have overpaid and am working to get pif letters and refunds) and have made payment arrangements with the 2 storefront (last payment in January). It just feels like a huge weight has been lifted from my shoulders and I am finally back in control with my paychecks. I still have a road ahead of me, but things are getting better.

I sent all of the necessary paper work to Great Sky, filed a complaint with the AG in my state and theirs. Heard back from Great Sky the same day. I'm waiting for a paid in full letter via mail and I have requested a refund for the amount paid over and above the original loan amount.
