I don't know what to do!!!!

I got a $14000 loan from Check n go. I live in Texas. After renewing six times at $330 each, I could not pay in June. Defaulted. Check n go said I owed $1539 after that, and I paid $500. Because I could not pay remaining $1039 as quick as they wanted, the sent me to VCS a collection company. Girl called and said she would settle for $800. I did not have $800 but I told her I wanted to make good on the debt, Check n go is legal in Texas, and they have my drivers' license flagged. I cannot even write a check at the grocery store!!! I paid her a $100 to show good intent on my part. It was all I had. NOW, VCS sent me a demand letter yesterday saying I owe them $1150! The amount goes up and down!!! Saying they have added back in interest. I asked them for their license to collect in Texas. I also wrote to Check no go, and told them I am reporting them because the are a CSO(I think) and supposed to work with me. Will VCS sue me? I have enough grief in my life right now. Trying to handle as many debts as possible with a husband who is physically gone. He left me, which is why I got in payday loan mess in first place. Thank you for help. I can't sleep at night due to worry!


Report this to the Texas Office of Consumer Credit Commissioner, call them at 512-936-7600 and tell them that an employee at Check n Go is threatening to have your driver's license "flagged". It's important that you complain to the proper authorities about this or it will never stop.

When there is a post dated check involved, yes, it's perfectly legal.

I would think that, if you went to a storefront CnG operation and actually wrote them a physical check, then yes - they should be able to report you for a bad check. If you completed an online loan, however, there was no actual "check" supplied so, I wouldn't think reporting you for a bad check would be legit and you should be able to dispute it. The driver's license thing is totally ridiculous. They absolutely need to be reported for that.

What type of "demand" letter did they send? Email, letter through the mail? They are required to send you a letter of collection via the mail, at that time you will have 30 days to send them a debt validation request, but you MUST send a debt validation request within the thirty day window provided or it will be assumed you are admitting to owing the debt. When you send the validation letter, send it certified, return receipt requested or there will be no proof that you actually sent it. All collection efforts must cease until the collection agency validates the debt.
