I had the misfortune of taking out this payday loan that continued to withdraw money from my account until I had to close the account due to fraudulent activity back in October 2009. I am still receiving phone calls occasionally as well as some emails stating that I still owe them $195 dollars on a $300 loan that I have already paid $845 back on. I live in New Jersey and I've read on some posts that payday loans are illegal in New Jersey. Since I already paid back the principal on the loan, I shouldn't owe anymore money. Should I send them a letter stating this and ask for a PIF as well as demand a refund on the overpayment of $545? I know I won't get that, but I figure it may be worth a try. Any advice?

Certainly. They owe $ 545 to you. It's your hard-earned money. Send them emails stating that as per law of your state, they are illegal and as such you only owe them the principal amount borrowed, which you have already paid off. As such, ask for a refund and a PIF.

Have you informed this to the New Jersey Department of Banking and Insurance and your states' AG? Send them the emails repeatedly, so that their inbox gets flooded. Eventually, they will listen.

Hi JLB,

I'm sorry that you tried to send me a Private Message but couldn't contact me. Actually, I have some reservations at my work, so I can't register over here. As for QXL Online, I think I was one of those lucky ones who got a refund from QXL. I continuously sent the letters asking for a refund as advised by Paul Mergel and Paul Cahill.

Here is what I just wrote and will copy and paste everyday. At the end of their last response they said "The matter is now closed and no further responses will be made. Customer Services "

Per my previous letter and e-mails, I am aware you are not licensed to do business in Virginia or anywhere in the United States. Therefore, I was only obligated to pay back what was deposited into my account. $200 was deposited into my account and $304 was debited from my account by you. I am hereby requesting a refund of the $104 that I overpaid. Thank you.

For those who have received refunds from QXL, how did they repay you? Was it sent by check?

I'm going to begin harassing them for a refund because I've paid overages of $228.

Thanks!
