Can a collection agency (NRC)working for the payday loan company attach my wages? They tell me they have now taken over my defaulted payday loan and are going to collect.


Have you received a letter of collection from NRC? Who was your PDL through. What state do you live in? How long ago did you default? How much did you borrow? How much did you pay back?

You cannot be garished without being sued first. The agency may be talking about a wage assignment that you may have signed at the time of your loan. Wage assignments are voluntary and can be revoked at any time. You may want to send a letter to the CA and your original PDL revoking any wage assignment you may have signed. You should also give a copy to your HR/Payroll department, just in case.

Pleasd do supply us with the info I requested in the first paragraph. You may not even owe these people anything further.

Of Course they can Garnish you. How else will they get the money back that you stole from them. They will also add on Court fees, legal fees, interest. You are in BIG trouble and will pay back a LOT more than you borrowed. That's what you get for being irresponsible. You should have paid them back on time, like you agreed to in the contract you signed. you are a DEADBEAT!

puh-lease humanoid.nobody can just garnish without a court order,and an an illegal pile of compost like yourselves have the same chance as ice in august.which is no chance in an actual court.so while you like to lie and exagerate over the phone.don't do it here.you look like an absolute fool.now back to the phones drone.

No letters received, I did however receive a email from them about 2 months ago saying that I owed 149.00 from the payday advance I had taken and this was there settlement offer. The original amount if I remember correctly was for 200.00 so I did pay them in 2 sperate payments. When I finished paying them they then came up with more money that they say I owe from the same original creditor. I do not remember the original creditors name and when I asked them for it because I did not feel I owed anymore money to them the women became irrate and told me that I had found them to make the original loan then I better take the time to find them now and it wasnt her responsibility to find it for me and she stated that she didnt even have that information. I then told her I would no longer deal with there company and would indeed try to find the original creditor. In the mean time I have received serveral more calls from this company threatening to attach my wages if I do not pay. I have yet to return any further phone calls from them and am in the process of trying to locate the original creditor. The loan if I remember correctly was taken out around Feb 2010, and I live in the state of Arkansas.

We need to know who your loans were through and whether they were online or storefront. Arkansas only allows PDLs to be given via check-cashing storefront establishments. I have a feeling your loans were illegal to begin with and these people are just trying to extort more money from you. Please give us more detail.

The original creditor was Arrowhead Investment on line payday advances for 300.00 no exact date that I could find. Then apparently it was sold to a Capture Financial,LLC witch in turn hired NRS, LLC (National Recovery Service) to recover the money. They are now emailing me with a bill for 462.00 and another for 132.00 telling me they will report me to a credit bureau and my teletracks will be affected, also they said they are going to place a judgement on me if I do not respond within the next 30days. Can they do all this or should I try to get intouch with Arrowhead?
Please you input is greatly appreciated.

I'm going to assume this was an online loan, which is legal in Arkansas as long as it's under $400. How much have you paid them so far? There is a limit to the amount of fees/interest you can be charged. I'm going to look at the licensing info for you. It's highly likely that you've already paid this off or they are unlicensed. This NRS is trying to scare you. Don't let them. Tell them you want a letter of collection as it is your right to have this debt validated.

The Arkansas State Board of Collection Agencies regulates both collection agencies and check cashing/payday loans. Explain your situation to them and file a complaint against this colletion agency. There is a complaint form on their website as well.
