Iowa Internet PDLs?

I wanted to clarify are internet PDLs legal in Iowa? I'm not sure what recourse they have against me if I cannot pay. Can they sue me even if they are not legal or licensed in this state?

Basically you are saying that since the are not legal in this state they have no ability to win if they take me to small claims. I'm assuming they are taking on a risk even to start an action against me in that case.

What can I do to avoid them from calling me at work or my cell phone then? I really don't want calls as my wife isn't aware of them.

They cannot win in small claims.

They can and will call you to no end. Thier calls will be mean, threatening and sound real official, but in the end, that is all that they can do. You will need to check the "sticky" at the top of the thread list to see how to handle illegal lenders. The real bad news is that your wife is probably going to find out when they start making calls, so I would make her aware of them now to avoid the uncomfortable discussion later.

The first thing you need to do is secure your bank account. You'll have to close it and open a new one as your money will never be safe again, now that these vulture have your information.

All of your lenders are illegal but you should repay them the principal amount borrowed. Any payments you've made thus far will be counted toward the principal balance. For instance, if you borrowed $300 and have made 3 payments of $90, you only owe $30. If you've overpaid, request a refund. Read this thread and move forward from there.

Thanks for the info from both of you. It's very helpful and gives me some relief. I have already opened an account through another bank and plan to close my current account.

I did read the link about how to deal with the lenders. If I send this does it work to keep them from contacting me by my cell and work phones? I have no idea when I can pay the principal remaining. I've paid some on the loans but not enough to cover the principal.

Aaron, PDL is right. There's nothing you can do to keep them from calling. When they figure out they aren't getting anymore money from you, they will eventually stop. In the meantime, you have to endure it. I mean, they already broke the law by lending you money. Do you really think they'll honor your request to not contact you via phone? You should advise anyone who was a reference, as well as your employer that you have been a victim of fraud and any calls they receive they should simply hang up and ignore. It probably would also be in your best interest to talk to your wife and explain to her what's going on.

Aaron: I too have a pdl loan with Integrity. They are the worse regarding calling. I have overpaid them and all I am asking for is a paid in full letter and a refund. However, they say I still owe. Over the last 3 months, they have called 3-5 times a day. I don't even bother answering the calls anymore. I am hoping sooner or later they will just go away.

I guess I had a couple follow up questions if anyone can help. I saw the template to send to each lender. If they will still call me what's the point to sending it? I don't mean to sound blunt but what can the letter help me with?

Also if I close out my current account will it effect my account thru the other bank. Example will I have checks rejected when I write them at a grocery store even if they are with another bank?
