CK Marketing - HELP!

I've talked before about CK marketing (formerly paydayonline) and how earlier this week a letter came adressed to our HR/payroll department (which I intercepted) talking all about me and my "bad debt" and how they were going to get their attorneys involved, etc. I reponded via e-mail to their letter (because I got the very same one at my home address) itemizing everything I had borrowed - a $400 loan and a $500 whose total payments equal over $2,700 - and letting them know where they could send my $1,800 refund. I also told them I had my own lawyer, they weren't getting another dime from me and, basically, bring it on.... That first letter from them was dated 9/21 and received on 9/27 and my e-mail response to them was later that same day.
So... today another letter came to my office, which I again intercepted. This one is threatening to send "my case" to their attorney in my "local area" to file for wage assignment. That letter is dated 9/22 - sent a full 5 days prior to my receipt of their first letter and my e-mail response. I know this is getting confusing... my point being, my e-mail to them that itemized what I've borrowed/paid came AFTER their threat of garnishment, so I just don't know what to make of it.... I might also add that they were calling me nonstop, but since I sent them that e-mail on the 27th, I've not gotten a single call.
Please tell me, experts.... since I do already know that CK marketing is not legal in Illinois... is there any merit to this garnishment threat? Based on what I've learned here so far, I'm thinking there's not, but even with everything I've learned I have to admit it's very nerve wracking and unsettling to receive a letter like this. Do I ignore it? Respond? Again, I've already responded to their first letter and phone calls with MY side of things and that response is dated AFTER the date of this garnishment threat letter. Does anyone here have any personal experience with this company under either of their names and know if they actually make good on these threats?

You can keep sending your letter every day if you'd like. There is no legal action to get a wage assignment. You can and should have already revoked any/all wage assignments you may have signed. If they approach your HR department give them a copy of the revocation. In the case of garnishment, you'd have to receive a summons from your county/city court and have a hearing before a garnishment would be obtainable. Since they are illegal, that won't happen.

Did they tell about wage garnishment or assignment in the last letter? They cannot go for wage garnishment as they are illegal. As for wage assignment, you can easily revoke it and give a copy of the letter to your HR department.
Respond to the letter stating that if they don't comply to your request within a particular time (say 72 hrs), you will file a case against them with your states' AG. I think it will help you.

I did revoke my wage assignment - the same time I sent the C&D and ACH revocation. The content of the letter was not for an "assignment" but most definitely a garnishment - as in through the courts. I kind of figured it was just a scare tactic and, given their illegal status, they couldn't actually go anywhere with it, but even knowing that it's still pretty rattling to see it all in print like that, you know? It's hard not to get scared....
I like your idea of my response to them though. I will definitely do that. Just the fact that the phone calls immediately stopped after I sent them the exact specific breakdown of what THEY owe ME goes a long way towards peace of mind....

Since ZIP19 is different than some of the others in that they do not roll over their loans, I was in the same payback/borrow again cycle as probably everyone here who's used them. Given that, I really expected they'd be all over me! The only thing I can figure is that my pointing out to them that all the fees I've paid over SO MANY loans through them (and I don't even remember how many times we reloaned through them, but I'm sure it's probably like 20 times) more than cover the $600 loan that did not get paid when I revoked my ACH authorization. I don't really know....? It's been a little over 3 weeks since I sent the letters and revoked ACH. We've had one pay cycle of all of the lenders not being able to access any funds and tomorrow will be the second cycle, so maybe I'll hearing something from someone after that. All in all, it's gone amazingly well and I am thrilled! CK marketing has been a real albatross though and sometimes their letters scare me a little, but everyone here has really given me the strength to not cave in to their scare tactics and hang tough. I'm fighting back and intend to beat them at their own game. I haven't really even gone after the "refund my overpayment" part of it - and if the others don't contact me I probably won't and will just be content to have it "over," but since CK Marketing is playing nasty, I am definitely pursuing it with them - especially since the overpayment amount to them is the largest - approximately $1800!

you should ALL know that they are a internet based company, therefore they do not have to abide by any state laws because they are not governed by state laws. They are governed by FEDERAL laws and nothing you throw at them state law wise is going to make a difference to them because they don't have to abide by any of them. Just trying to help you all out, I know that because I used to work for a similar type of company and no state law can touch them because they are internet based and therefore federal jurisdiction!:(

Oh and you wont ever see any refunds....the reason some of you probably havent heard anymore from them is because they forwarded your account to their attorney's office and those guys do not play, they wont contact you...they will immediately file for wage garnishment and just start having it taken directly out of your paychecks...thats how these companies work. They attempt to work with you and when you won't work with them..they turn you over to their attorney and they handle everything from then on and do not have to contact you before filing legal action. You're best bet is to never get involved with them in the first place...sorry

Just don't get involved at all with any of these people, it's your best bet. Ask family, friends, co workers or just let the lights go out for a few days before gong to any of these places. It just isn't worth it

I filed all kinds of complaints and CK marketing answered them and my reply from the attorney generals office was - I WAS REPSONDSIBLE FOR THE PRINICIPAL AMOUNT! They hired some attorney in my state and city who filed for garnishment and won. The judge had NO pity or mercy on me. Anytime a pdl company offers you a payment plan or settlement - TAKE IT! IF it goes to court - and they can prove they offered you payment plans or a settlement, they judge will find in their favor. That IS what happen to me. So, Donna - i am not sure what happen with your situation - but I was able to reach a resource and they assisted in helping me by educating me on the laws and what I can and cant do and who MUST and MUST NOT abide by the FDCPA - Original creditors are not covered by the Fair Debt Collection Practices Act, however, many states have laws which have similar protections from original creditors for consumers in debt.

If you owe CK marketing or any other company - be very very careful - most of them will always TAKE way less then what you owe. I wish I would have done that!
