I sent first DV to Zwicker that was hired by AmEx and they replied by sending me a copy of the last billing statement. Does it answer to my DV? What should I do?
Secondly, it has been a few days since I got their reply letter. TODAY I was out working. Lady stopped by at my home asking for me and my husband told her I was not home. She left. I suspect that she will come back tomorrow with a summons. What should I do?


I beleive they are suppose to send statements for last 12 months. Zwicker is bad news though and do not follow protocol. As far as visitor to your house, seems early for summons. How much do you owe.

American Express does not often sell debt and probably assigned to Zwicker to collect on their behalf.

You need to research Arbitration clause in Amex cardholder agreement.

For now it is just a wait and see. If a summons send Zwicker letter saying you "elect arbitration" as per cardholder agreement. Of course answer summons also.

I owe 23,000.
Where can I find the Amex cardholder agreement? Anyone can assist with this?
Can you send me a sample letter. Do I need to wait til I receive the summons before I send out "elect arbitration?"

You do not have to wait till summons. You may find cardholder agreement at this web site http://teh402.blogspot.com/ Slow to open.

American Express has ARB clause

Letter can say "As of 9/30/2010, I hereby exercise the arbitration clause in any underlying agreement between us. If you litigate after receiving this notice of litigation waiver, I will pursue all remedies available under Federal and State law for exercising a legal right that does not exist after you receive this notice.
