payday loan hell...

hi everyone...I am so glad that I found your forum....

I have also gotten myself into this payday loan hell. I am so far behind now with my car payment and other bills, that i am even more worried about it all.

has anyone had to deal with any of these internet PDL's?

these are the ones that was able to get loans from when I was broke from another company taking out there fees. I get paid bi-weekly and I cant even look forward to getting paid because I know that they will take out most of my paycheck. I have managed to close my account so that they cannot withdrawl from it, I hope...so now I am not sure what to do..do I just wait for them to start calling me? I dont want this to interfere with my employer or my wages. I am ashamed that I have had to go this route with trying to get money to pay bills and just survive, especially knowing that it was the wrong thing to do, but I was at rock bottom and nowhere else to borrow money from :(

anyone have any suggestions that may help me further, please let me know. It will be greatly appreciated. I just dont know how much more of this I can take...

I am in NC and from I have been reading these companies are illigal...yes, they are all internet loans.

CMG Group LCC: loan was for $250 (with interest=$325) have paid $150

Advancemetoday: loan was for $500, have paid $450 (only finance charges, nothing went to principle)

ezpaydaycash: still owe $774.80 (the original loan was for $600)...I have paid about $400

Nationwidecash: loan was for $500, have paid $300 (finance charges only)

Paydaymax: loan was for $630 but with interest = $831.10 owed)...they are not scheduled to take anything out until 10/14/10...this is the newest loan. I had one with them previously and paid it off and had to get this one because the others took almost my entire paycheck.


I have used Paydaymax twice for loans and expaydaycash maybe 4 times, but the others are their first time being used. So with Paydaymax and expaydaycash, they have both taken alot of extra money for all their previous finance charges when I had to keep renewing them.

Payday loans are illegal in the state of NC. Al of your lenders are illegal. You are only required to repay the principal borrowed. Any payments you've made thus far can be subtracted. Here's what I would do...

First - close your account and then follow the advice in this thread. debtconsolidationcare.com/paydayloan/illegal-pdl-dealings.html

CMG - you owe $100
Advancemetoday - you owe $50
EZpaydaycash - you owe $200 but I would research your previous bank statements and subtract all overpayments made. Ask for a refund if applicable
Nationwidecash - you owe $200
Paydaymax - you owe $630 and I would do the same as with EZPDC

what do I do if they do not respond before the deadline that was given? I gave them 72 hrs to respond and as of now, I have not heard from any of them.

ok, I closed by bank account and sent out letters to the companies explaining what what going on and how it is illigal, etc...the only company that has responded to me so far is Nationwidecash..below is what he sent back to me..

Let me get this straight. You have signed a contractual agreement that states you agreed to the terms of this loan and are not sending a letter stating what you will pay back and you will not comply with the terms of the agreement? Because NationwideCash, Inc wants to resolve this voluntarily, i want to give you the opportunity to contact me by 10/14 which is your next payment due date. If i do not receive a call by that time frame i will continue with action against you. While you are deciding to do this i will investigate the IP address you used to obtain this loan. I'm sure you are writing the other pay day loan companies the same letter. However, this company is bonded by federal law which means your state law does not apply to our company. Because federal laws supersede state laws it is very important you contact us for a payment arrangement. At this time your full balance is due and i am willing to work with you, but if i do not receive a phone call for a payment arrangement by tomorrow then the full balance will be due. This will be the last email i will write to you concerning this. You are welcome to do as many research as you want on federal, but state laws do not apply to us because you agreed to our loan documents. Good luck with your future finances. I look forward to your call.

this is what I had said in my letter that I sent to them..

[COLOR=#333333]I am willing to pay the remaining principal amount of the original loan of $500.00. I have already made 2 previous payments of $150.00 each, which is a total of $300.00 put towards the payoff of this loan. I will settle my account with a final payment of $200.00, which will be paid in 4 separate installments of $50.00. I will upon your written acceptance of the above terms, provide you with this payment using certified funds (money order, cashier's check, or wire transfer, etc.). The remaining amount owed, which is any finance charge, will no longer be negotiable.[/COLOR]

The email that you received from Nationwide contains the usual misleading and threatening lines that illegal PDL lenders use to scare consumers. Don't worry, they cannot do anything. Just notify your employer that you are being harassed by these illegal PDL companies.

Also, file cases against them with your states' AG, the FTC and the BBB.
