capital one suing me for 3800

they filed suit last week, i am in new jersey can i settle with the attohrney before trial , would like a monthly payment plan. it charged off in march after i made less than minimum payments up til febuary 2010..

That's not much of a settlement, my friend. You are still paying the full amount. You just became that collection attorney's wet dream. If you are going to settle for the full amount, I would at least push them hard to remove the charge-off from your credit report. Otherwise, I would answer the suit and let it go to trial. Worst case scenario, if you get through discovery phase and feel that they have solid evidence against you for the full amount, then I would settle to avoid a judgement on your credit history. Best case scenario, they are just BSing you like most credit card suits, and they will dismiss the suit if you answer the summons and fight them back. Stand up for yourself. Don't let them steamroll you. Hell, in most states, you can hire a decent consumer attorney to defend your case for $1000. A competent consumer attorney can 9 times out of 10 beat these scumbag lawsuits. Those are pretty good odds. Which would you rather spend...$1000 or $3800?
