Financial Affidavit?

Hi all! I am in need of some serious advice.
I have a debt originally with American Express that has been passed along for a year or so now. It has ended up with a law office here in my state. They recently had me served (via a police officer). After being served I called them to make arrangements. They sent me an agreement which included exactly what we agreed to (paying x amount every month by a certain date). I happily signed the agreement and sent it back with my first months payment.
That was two weeks ago. This past Wednesday I received a letter from the law office which included a "financial affidavit" which asked for all kinds of information such as my employment information, cars owned and bank account information. The letter also asked that I include my proposed payment along with the filled out affidavit. Having sent in my first payment already I called the law office Thursday and asked what this was all about. The lady told me it was "standard procedure" since I was on a "hardship payment plan".
The problem is I in NO way feel comfortable giving this business my bank account information. Am I required by law to fill out this affidavit? Are there any alternatives I can take? I am so worried about this. Any advice is appreciated.


Your are not legally obligated to provide the information unless it has been ordered by a court. However, they do have the right to say they will not give you a payment plan without the information. Since you did not know this was necessary before the letter accepting your payment plan, I would just simply not return it and see what happens. Keep making your payments on time and you will probably be okay.
