Please help with Weltman,Weinberg and Reis
Date: Sun, 10/03/2010 - 20:49
I recently returned a summons and was ordered a court date for October 15. The debt is for $4800 and is through Weltman Weinberg and Reis (Discover). I called them to propose a $100 a month settlement and asked them to mail me the forms agreeing to this premise. I received the papers today but the wording includes the words "Order of Consent Judgement" along with the agreed notion of $100 a month until paid in full. Will this wording now make it legal for it to show up as a judgement on my credit report? Is there anything I can do at this point to minimize more credit damage?
Will bankruptcy dismiss a judgement if I end up in that situation?
Also, how should I send payments to Weltman? Personal check I know can be traced, but I dont like them having my account info? Are cashiers checks traceable?
Thanks very much for any help,
Bob

Thats basically a judgement you are agreeing to and will show as such on your credit report. Payments done in money order or cashiers check is the safest way to go. And yes Bankruptcy will wipe out any judgements you may have.

Thanks for replies. Yes, I do have about 30k in collections with various credit cards. I've been holding off on seriously contemplating bankruptcy as a lawyer told me I should wait until my car lease is expired in January and I receive the bill (3k) for my over mileage fee.
Just agreeing to the $100/mo settlement at this point to postpone things a few more months. Really was hoping to avoid the "judgement" but if thats on this then it sounds as if I might be just as well off claiming bankruptcy and starting over.
