Capital One Arbitration

My last payment was May 20th 2009. They state they wrote off the account in January 11th 2010. How does cap 1 arbitration rules apply to this date? I have been summons to appear in court October 20th and cap 1 is listed as pettitioner represented by Irwin James Frankel.

This answer comes a little late to help you with your October court date, but I am going to answer it anyway in case it might help someone else.
The cardmember agreement that you should use should be the year of your default. However, there is a possibility of using "older" cardmember agreements if they could help you. Some of the earlier cardmember agreements stated that the terms would survive any "changes" in the agreement which might be beneficial to the consumer.
