Payday Loan Help in AZ
Date: Wed, 10/06/2010 - 11:54
I currently live in Arizona and have 3 payday loans that I can't pay. I am embarrassed and ashamed that I've gotten myself into this trap. I can no longer afford to pay these. I have already closed my bank account so that these PDL lenders won't access to my account any more. I have yet to notify them of my account being closed and to not contact me via phone. Before I do I would like to know if these lenders lending illegally? And if I have any room to negotiate or settle these accounts since they are illegal to the best of my knowledge? Here's the info and I hope someone can help or give me some advice on how to handle these.
1)Live in Arizona
2) 3 Loans that are all internet
3) Cash In A Wink- $300, taken out in June '10, extended 9 times for a total amount of $860 to date.
Easycashonlinestore.com, $300, taken out in August '10, extended 5 times for a total amount of $405.
Paydayloanyes.com, $200, taken out Aug '10, extended 3 times for a total amount of $180.

All the 3 are illegal in the state of Arizona. You are only morally liable to pay the principal amount borrowed. Since, you have already taken the most important step and closed your account, you should send letters/emails/fax to the PDL lenders stating that you have revoked all ACH authorizations and will only pay them the principal amount on the loan.

I have my letters typed up and ready to send out to each of the illegal lenders. I've already paid CASH IN A WINK $860 to date in total fees and Easycashonlinestore.com $405. Cash In A Wink's loan was for $300 and Easycashonlinestore.com was $300. So I've techincally already paid back the prinicpal on both these loans right? Also, looks like I would only pay $20 to Paydayloanyes.com since that loan was only $200 and I've already paid them $180 in fees. Am I understanding this correctly? I just want to be since I know they will be calling me once they get my letter. Thanks for all your help and advice.

Yes, you are. You should also ask for refunds from CASH IN A WINK ($ 560) and from Easycashonlinestore.com ($ 105). As for paydayloan yes, tell them to provide you with an address where you will send the remaining amount of the principal via money order. Best of luck and keep us posted.

So I emailed letters to the these PDL companies and also faxed a copy. I have not received any responses other than a phone call from a Mr. Smith with easycashonlinestore.com today. He called me at work asking how I would like to take care of my loan. I informed of the letter I had emailed and faxed twice (once directly to him and once to the customer service email). I informed him the loan is illegal in Arizona and then he told me "so you took out the loan illegally, fine but I will contact your employer to take care of this." I started to say he is not to contact me at work and right in the middle he hung up. What should I do next? Should I tell my HR department about this? Also, what should I do about the companies that have responded yet? Should I still mail this letters out certified mail? Any suggestions would be helpful.

Let your boss know you are a victim of a loan scam in case they do call. Yes, send your HR department a "wage assignment" revocation letter..make sure they know you have revoked any wage assignment you may have authorized in the past. Send letters via email and certified mail to any company that has yet to respond.
