I have seven outstanding PDLs with the following companies:

Everest Cash-$300/$45
LoanPoint USA-$300/$90
CashDirect Express-$400/$106
PDYServices.com-$200/$55
OneClick Cash-$300/$90
Discount Advances-$300/$35
United Loans-$300/$90

My problem is I had to shut down my bank account and sent the letter to most of them (Unable to get PDYservices.com's e-mail contact). But they disregard them and claim that their state laws make the contracts legal and binding. I have entered payment arrangements with three of them (CashDirect Express, OneClick Cash, and United Loans). My question is, when the other four come calling, how do I explain to them that they have to wait until these other three are paid off?? I cannot afford to pay them all at once and still cover my regular expenses.

I'm sorry to tell you this, but, even if you put these illegal lenders in the BK it won't stop them from continuing to harass you, they are ILLEGAL, they do not follow the law, most of them aren't even located in the U.S. so they have absolutely no reason to honor a BK, and won't.

Filing complaints with the proper authorities (FTC, AG., etc.) is a good start, making those complaints informational and clear is another good start. Keep the complaints flowing in, don't just fill out one complaint and expect results, file follow up complaints with as much information as possible.

Also, educate yourself on your rights, understand the law pertaining to this, be informed and stay informed. Pay it forward. :)

I'm not so sure about that, the attorney that I spoke with said even payday debts can be discharged, but I'll find out more when I meet with him on Friday.

Oh I'm not saying they can't be discharged, I'm saying the illegal lenders won't abide by it.

I have to "second" what Shazzers is saying; the illegal PDL's are shamless - they threaten people like you and me and say that WE aren't obeying the law, however, they hide out overseas or on Indian tribal lands in the U.S. so that THEY are immune from any legal action.

I would like to add my two cents as well. They are ILLEGAL. If you choose to pay the rest of the principal (it's the moral thing to do) do not let your other bills get behind in an attempt to pay these illegal companies. Pay them by money order to a physical address when YOU have money to send, not when they demand it. A bankruptcy ruling will mean nothing to them. If they call and threaten you with wage garnishment/arrest/jail/lawsuit...just laugh and ignore it. They can't do any of those. You should also follow the advice given to you above..go look at the sticky thread "Dealing with Illegal Lenders". Send copies of the letter to each lender, give copies to your HR department in case they attempt a wage attachment, and file complaints with the BBB, FTC and the NY Attorney General. Good luck to you!

Good luck, as I said before, most Internet payday lenders aren't even located in the U.S., they obtain an address in the U.S. which usually turns out to be a front. It's like trying to sue a professional criminal who is on the run or lives in another country and hides behind fake addresses and spoofed phone numbers.
