LoanPoint and DJR Settlement HELP

Hello All. First off, I want to say thank you for this website. It is so informative, and you all are so helpful!

Now, I took a loan from a few companies
LoanPoint: Borrowed $600, paid $1080
DJR: Borrowed around $200, paid at least $350. In collections with NCA
QXL: Don't remember. Working on that

I sent LoanPoint and DJR/NCA the payday lender letter to inform them I was stopping all debits, internet lending is illegal in Kentucky (Only check cashiers are legal), and that I was due a refund.

Now, a refund would be nice, especially on the LoanPoint overpayment, but honestly I would just like to be marked paid in full because my DJR loan is already in collections. After sending LoanPoint the letter, their operations supervisor contacted me to say that I had already a settlement agreed to was already in place. The settlement I had agreed on earlier before finding out all the information here, and it was to pay the principle by October 30th. NCA also wants me to pay $430 (principle plus fees and charges) by November.

Now, I'm a good honest person, and I would be happy to pay these off and clear my name of them, but I was just laid off from my job and have no income. In addition to these loans, I also have private student loans to worry about. What can I do with these? I have well overpaid LoanPoint and I tried to make good honest arrangements with both companies because I lost my job, but NCA seems to be unwilling to work with me at all. I would really just like to try and get a "paid in full", but a refund would help pay back the huge overdraft they caused on my bank account. Please HELP :-)


tell both pdls or their collectors you are filing AG,AND FTC complaints.then do it.i believe you are a good honest person.unfortunately everyone in the internet pdl and collections of such are just the opposite.they would not only sell their own mother to make a buck.they would send her C.O.D.unless you got this bogus arrangement in writing which i doubt then i wouldn't worry.you did nothing wrong,and are entitled to refunds on both.however file the complaints and ignore them after that.let your AG do their job and fight these idiots for you.focus on your other debts like the student loan,and give these losers no more of your valuable time.

Okay. I will follow your advice. I'm just a little nervous b/c the collections for DJR Group (NCA) is threatening legal action against me, EVEN THOUGH I attempted to talk with them and make some type of payment arrangements. They were just nasty. They even hung up on me. So, I really just want to do the right thing not weasel out of my responsibilities, but it seems like nobody has empathy for sticky times.

no problem,just know that DJR(NCA)are illegal themselves and therefore can't and won't do anything except call and stupidly threaten.btw please understand not only do you not owe either place.they owe you refunds.your AG should help with that.do not even think about paying on these any further.

Reply to Judas: I also had a payday loan with DJR Group and I had found out that payday loans were illegal in New York State. I refused to continue paying as I had already paid the principle and then some, so eventually it went to collections - yep NCA. You're right they are nasty. Kept calling my cell phone four or five times a day. Kept leaving messages, etc. I finally got online and found a law firm in California - solicitation removed per the TOS Sued NCA, got a settlement and 2 payday loans that were on my credit report got wiped off. Hang in there - sue if you have to!!!

Hey guys. I'm back again. Thank you for your help. So far, DJR/NCA has backed off, but I have not received any indication of a paid in/refund.

LoanPoint, however, is NOT working. I sent them the letters suggested by these forums, and they did not respect anything in my letter. I said I wanted everything in writing, but they only call. They have not offered any documentation, and messages left by opeations supervisor Ashley said they do everything by phone. That's how their communication works. I was not taking their calls because I don't want anything being used against me. Now, I'm receiving calls from Shantae McIntosh...I believe she may be someone of authority at the company. We've have not been able to touch base because I have a lot going on trying to work to pay my debts and spending the rest of my time at the hospital (my good friend just died yesterday, but he's been there for weeks). I'm not sure what to do now, and I get scared. I just try to do the right thing.

Any suggestions? Please.
