Being suid but not served, can we send debt back to creditor

Hi if there is a lawsuit but I have not been served by the collection agency/attorney can I send that debt back to the original creditor? (credit card debt) if so what form should I use?

who sent the letter and what state are you in?a couple of things.

1)check with your court clerk to see if there is a case on the docket.you can ask by either using you(defendent)or the agency/attorney(plaintiff)if there is nothing as far as a case then you can inform the OC of the illegality of this.it might help in maybe the OC might not use this CA as much.if this is bogus which it could be i suggest.

2)go to www.naca.net there you will find a contigency lawyer that will sue this place and you pay nothing out of pocket.however this all hinges on when you check with your court clerk and find out for sure what the deal really is.
