I received a civil suit summons from Asset Acceptance for a debt I don't have knowledge of and is not on my credit report. the summons says to answer them in 28 days but the only address is a po box How do I respond to this and have it dismissed in court?

you don't answer to asset acceptance.you answer to your court clerk.go to the clerk and file your response as you posted here.that you have no knowledge of the the debt whatsoever.again you are not to contact the plaintiff.go to your court clerk and file your response with them.we can advise further from there.

Watch out for these guys. Talk to the clerk and get as much info as you can on the supposed debt. They like to tell you the court date is off to try and get you to no show after you've worked out a deal with them to avoid mediation. I showed up and both the court and the mediator had no idea we had worked out a payment plan...nor did the his contact at the company. Shadiness at it's worst.

First things first--what state do you live in?

When you received the summons, did it come with a complaint? Did it list any details at all about Asset's claims against you? If not, the court clerk's office may have more info for you.

OK, it isnt on your credit report--this could mean one of a few different things. It may not be your debt. It could be so old that it has passed the statute of limitations for reporting. It could be that it isnt that old but that the creditor never reported it. It could also be on one of your credit reports, but you checked another one and didnt see it there.

Please get back to us on this--we can offer a LOT of information to you on how to deal with this.
