I had a Kay Jewlers account that I paid of in 1993. I am now getting phone calls from Portfolio Recovery stating that I not only owe the money but am to provide them with proof of payment to Kay from 17 yrs ago. This is insane. When I told them that they were way beyond any reasonable right to contact, report or collect even if I didnt pay it off they told me they had every right to and unless I proved that I paid them I would continue to be contacted. My state is Maryland, how is this possible?

The SOL for this type of account is 3 years in Maryland. Mail them an FOAD letter (f**k off and die!!!)tell them to take hike, pound sand and NEVER contact you by any means again!!! Make sure you send it certified mail, return receipt requested.

I think this is a scam. Don't give them any personal information of any kind. I would just ignore it. That can't sue you at this point and no one would have records from 17 years ago - well except for my ex mother in law who has file cabinets full of records back to 1934, but other than that no one. LOL

I wouldnt say it is a scam....just an agency collecting on old paper. Most people are clueless on SOL. The debt is still collectable, but not enforceable in court.
