Capital One settlement

Capital One summons me to appear in court so they may receive a judgement. This is a business card for the house flipping business I use to have. I researched the arbitration method and found a dead end primarily due to the fact it is a business account and does not have all the consumer protection laws applying to it. The day I am scheduled to appear in court I negotiated a 62% settlement agreement to be paid in two 30 day payments with a 100 dollars paid immediatly in good faith. They said they will ask for a continuance on the case and dismiss the case when the debt is paid as agreed.

I think you should have asked them to dismiss the case. There is no point in settling the debt if they keep on continuing the case. You should approach a lawyer and hear his opinion about the issue.

Don't know if it'll help anyone else but I settled a cap1 awhile ago at or around 50% which is way too high, but got it over with in 6 payments of 750...Cap1 will settle even post judgment at 50%
