I live in VA had a payday loan with National Payday Loan, I paid $180 on the $300 loan, hard times hit and I was unable to make the payments. They have turned over to LRA that states I owe $666. I sent the letter at the top of the forums. I got a call today which was escalted to management because I asked for the DV to be sent. He said that they do not have any of the information and it doesn't matter they will still collect. Internet payday loans are illegal in the state of Virginia, so I realize I only owe $120. This guy was so demeaning and really got me upset. There is nothing else they can do correct? I advised I would respond when I had a validation letter in my hand, he said they have sent two-I have received nothing. How should I proceed? Thanks in advance

Was this by internet or storefront because in Virginia, Internet payday lenders are not legal, either because of restrictive laws, or because the state does not license companies not located in that state, but requires a state issued license to lend. If it was by internet, then I would think you would only owe what you borrowed, nothing more or nothing less. Send them a validation letter either via email, fax or certified mail. When they call, just tell them that until you receive the validation letter, you will not discuss this matter with them and then hang up.

This was an internet loan, on the phone I advised I lived in VA and knew the laws about internet payday loans, he started a spill that I took the loan out and have to responsible. I then told him I wanted validation, until no more communication and hung up. I have emailed and faxed the letter.

Well, first of all, NEVER admit to owing a debt to a voice on the phone, NEVER.

Second, the next time they call, tell them they are required by the federal law (FDCPA) to send a letter of collection via the mail within five days of their first initial contact with the debtor, and unless you receive the required documentation in the mail you will NOT discuss an alleged debt to a voice over the phone, THEN, if they continue to call, file a complaint against them with the FTC, BBB and your attorney general's office, and change your phone number.

I TRIED to keep cool, but these guys know what to say to get under your skin! I don't think I admitted anything and also would not discuss any sort of money, what was owed. They said they have sent two letters, I received nothing. I am sure this is not a collection agency to believe. I was told they just get names sent over with amounts owed, I should have paperwork from where the loan orginated. I then advised I needed something in writing that would validate any sort of debt. I guess if they call again today I will advise to send something in the mail and hang up.

Update! I filed a complaint with the BBB, they claimed to have sent the DV letter twice, to which I have responded I have seen nothing. The rebuttal was they were now mailing it certified mail. Which I will believe it when I see it. Has anyone ever received anything from LRA? Nasty bunch of people!

not really.any info people get is from google and sites like this one.don't hold your breath waiting.
