Midland Funding LLC has Put a lien against my checking accounts. They contain only Social security Disability Income, We were never notified in writing that they were going to do this (as is required by law) and this is on a 6year old credit account that we defaulted on and our states statue of limitations is 5 years on credit card debts. They have broken at least 2 state and one federal law that I am aware of. What should I do? How do I contact them as I cannot find a website, E-mail address or mailing adress for this company. I have already changed my S.S. checks to be mailed to me instead of direct deposited, I hope this takes effect before Nov. 3rd or My wife and I will be left with no money for bills or food! Can you help me with any information??

You are missing something here....somewhere along the line they got a judgment. Once they sue you and get that judgement, the SOL starts all over again for up to 20 years...most states have an SOL of 10 years.

So...did you receive a summons? Did you answer it? Appear in court?

If you did not receive a summons you need to go to the court website and lookup the the judgement information. You will then have to motion the court to set aside the judgment for lack of/or improper service. You can also notify the court that they have garnished expempt funds.
