I am NEW at this but here it goes.... Today I got a letter saying I owe providian Bank $3,000 - but it's from two different collections companys -
One named Pinnacle credit and the other is Vision financial collections - Now they say I owe this min it now two months - I am NO kid and never have owed any onto the credit reporting agencys and yes distroy my cret wont say HOW it's me or WHY I owe said moneys -

redit messed up over a bill I do not owe or did not make!
cember 1st -

I would actually get some insurance on this one.

What state do you live in? Most states allow you to record a phone call without the need to inform the other party. If you live in a one-party state, I would DEFINITELY call them back and record the call. On that call, I would talk about how this debt is from 1999. I would get them to talk about it. And then, I would have it on tape that this debt is from 1999. So then, if they try to report the debt to the credit bureau, you have them caught red-handed. The law allows that a debt can be reported on your credit no longer than 7 years plus 6 months from the date that the debt first became delinquent. So, that date has long gone. And now, the only way that they could get a credit bureau to list it on your credit file is to lie about the age of the debt. It's called re-aging, and it happens more than you might think. And it is 100% illegal.

So, I would check to make sure it is legal to record phone calls in your state without telling them, and if it is, I would record them telling me that the debt is that old. And then I would go to www.naca.net and look for a consumer attorney in your area. Usually, the initial consultation is free, and in a case like this, you most likely wouldnt have to pay a penny out of your pocket because many of these attorneys work on contingency basis--meaning they collect their fee from the debt collector that is pulling this nonsense. As it stands right now, you have them solid on FDCPA violations, and if you were to sue them, a court would order them to pay you an amount up to $1000 plus court costs and attorney's fees for breaking the law.

d ) to be listed on credit reports can send in a claim on me at any time - for being late to not paying a bill! No collection company has to show proof of said claim, nothing unless I say it's wrong or not me.
I only have 28 days left to pay or send them a letter to validate the claim - if they say it's mine then I have to pay even more!
I do not have money to play there games!

To me the LAW is not on my side and I have to do all the work for a bill that is not even mine - They the colleaper to back myself up so it's there word and fake dates that get away with said collections:

let me fill you in on some bits of info.

1)both pinnacle and vision are dirty bottomfeeders that buy or acquire zombie debt,or get a person's info to phish for $$$$
2)if you send a DV(debt validation letter certified mail return receipt then they can't do jack to you including putting it on your CR.
3)you don't have to prove anything.dispute the debt, and the JDB has to prove you owe it.not vice versa.

in short you do have rights, and the law on your side.use it.get the DV letter certified mail return receipt out asap.

Well none of this was ever on my reports from the credit companys!!
If I had a debt from providian way back they would have posted it on my credit reports!
So I know it's fake and Vision just trying to milk money out of who ever they can get on there fishing line!
Most are out to distroy who ever they can and do not care about YOU or ME..............Bottom line for collections is $$$$MONEY$$$$ no matter where it comes from the main goal is $$$$$$:

But let them read what they wont I will NOT give in or give any one of them a dollar!

Yes, I did get the email. Looks to be a standard letter, and it did include the disclosures as required by the FDCPA. But it is a little obvious that they are only out for a quick buck. One thing though, I did not see anything about them saying that they would report this on your credit report. Do you have anything in writing from them that claims that? Could you send me a scan of that one as well? Thanks

Jon

*update Via the credit reporting agenceys Experisan - TransUnion -Equifax - I called them and wrote them to watch for said Vision collections - I was told until such report is on my credit report there is nothing they or I can do! I asked them to put said information in my credit file - showing it's not true on what Vision is saying I owe! I was told they can't do this cause Vision has not posted any information being negtive!

I was told said reporting credit companys are not on MY or YOUR side and NOW I know it's true! - So what it comes down to is YOU have to let a collection distroy your credit - then ask them to prove it's a lie! I even went as far as saying re-dating fake reports and they said they know nothing about companys re-dating to get on ones credit report!
So unles you can prove 100% in paper work it's NOT YOU or ME your screwed!
Now I am still waiting on Vision' s proof it's NOT me BUT I will bet you my house payment they say it's ME (with fake paper work re-dating and so on ) and will as they are trying to do make me and others pay for old and re-date to fool the credit companys!
sad world we live in today!
