Ms. and Mrs. Yaecker: I am in receipt of your correspondence and have reviewed your account history. All activity on your accounts was frozen at the end of September 2010. I do apologize for the delay in reviewing and responding to your letter.
In reviewing your accounts I determined the following:
· For the joint account of Kenneth and Linda (xxx-xx-xxxx) we acknowledge an overpayment amount of $400.
· For the account of Kenneth (xxx-xx-xxxx) I see that a loan with a principal amount of $300 was issued on 8/27/10. To date we have not received a successful payment on this account.
In order to rectify this situation I would like to deduct $300 from the overpayment amount of $400 to pay the principal amount only on Kenneth Yaecker’s account. I will then issue a refund check in the amount of $100 and provide a letter for each loan stating that both loans are paid-in-full.
Please let me know if this is an amicable resolution to this situation and I can have the refund check and letter(s) mailed to you on Monday.

I, too, am having a loan from VIP. An I am from Florida. Your store has really given me hope. What steps did you follow to succeed against them. Please let me know. I have a loan of $400 and till date, I have paid them $ 877.50.
I took all the steps mentioned on the forum. First things I did

First things I did was to make claims with the FTC, California State Board of Corporations, and the AG office. I used this in my correspondence with VIP so they knew I was not just off the turnip truck. I altered my ACH letter and other communications taking a VERY firm stance against predatory lending. Actually chastising them for operating without licenses.
It was not until a week ago discovered the 'man in charge' who should be getting these letters. I think the reason it took so long is the minions in between the top guy and the initial certified ACH letter. So I resent my communications to this guy along with a new letter outlining my payments vs principal, then saying "It seems that you actually owe me a refund of XXX. I would also like a PIF letter from you as well.
But the main thing is I came across as knowing what I was doing and that I was not going to tolerate this bullshit. The forum here gave me the confidence to approach it in this way.

Please keep us updated and let us know if you get the refund and PIF letter. I overpaid one of my pdl and I asked for a PIF letter and refund. After telling me that they would send me a refund and pif letter, I only received the pif letter and explanation of why they decided not to send a refund.

I received another email from VIP, this time telling me that I'm in default and that if I dont pay them back they are sending me to collections. I resent my C&D letters to the main email address and then followed up with forwarding all of the emails to the email address above alongwith telling them that they are well aware that they are operating illegally in MD and that they need to cease giving these loans out to MD residents and that if this doesn't meet my satisfaction, I will send followup complaints to BBB, FTC and AG's office.

I have reviewed your account activity and discussed this situation with management. Your loan was approved in error and the staff responsible for this were admonished accordingly. I do apologize for any inconvenience that this may have caused.
In order to correct this situation I would like to propose the following as an amicable resolution:
? I will charge off the balance on your account ($xxx). There will be nothing owed/no balance due.
? I will issue a refund check in the amount of $xxx together with a letter verifying that your account is paid-in-full.
? I will freeze and permanently close your account.
Please let me know if this is an amicable resolution to this situation and I can issue and mail a check within one (1) business day of your response. Upon receipt of the refund check I would respectfully ask that you contact whatever agencies or companies you contacted to file a complaint and let them know that this complaint was resolved amicably.
Please note that we are closed on Thursday (11/11/10) in observance of the Veteran’s Day federal holiday.

Thank you for your prompt response. I have reviewed your proposal as well as my records. My records indicate that the total principal of the loan was $xxx and I made payments totalling $xxx making an overpayment above the principal amount of $xxx. Since you acknowledge that the loan was approved in error and in the spirit of compromise, I would be willing to split the difference at $xxx along with a letter verifying that my account is paid in full and I will consider this matter resolved. Once I receive the refund and paid in full letter, I will notify the agencies that I filed complaints with to notify them of your prompt response and swift action to resolve this matter with me. Should this be acceptable to you, please let me know via email and I will expect to receive the check and letter sometime next week.
Thank you again for your prompt and swift response in resolving this matter with me. I do hope that your company will cease issuing loans to Maryland residents since payday lenders are illegal in this state.
