Release of personal information to collection agency

We were recently contacted by a CA to whom AMEX had referred our account. It turns out that AMEX has released personal information on my wife and me including social security numbers and bank account information. Is this legal? Can AMEX send this out to an unaffiliated third party w/o our consent?


It may comfort you to know that AMEX, if they've hired this CA to work on their behalf, will have a Business Associate Agreement and/or contract with the CA and are required to ensure the confidentiality of your personally identifiable information. The CA should take the same precautions with your information as AMEX promised you they would.

If you're not paying your CC payments, what did you think would happen? You had to know they would eventually refer it to an outside CA. They have to share your information with that CA so that they can locate you and convince you to pay the debt.
