I just received a summons from this JDB called Midland Funding LLC. No notice what so ever, just a summons served to me today. I've been out of work for the last 2 and a 1/2 years because I'm taking care of my Mom who has Dementia and we're living on her small pension and SS. In fact, that was why I went into debt with Cap One which is where this company bought the debt from. It went from a $5,000 debt with them to a $11,839.46 debt with this JDB. I have no money, no property and nothing but a car. My mother's home will go back to the Reverse Mortgage in a foreclosure because it's upside down now and in great disrepair. Needless to say, I can't afford a lawyer. I live in Long Beach Ca., is there a lawyer here that could do it Pro Bono? I tried Legal Aid and they said they couldn't do it. Also, you say to send off a DV, and you do have 30 days to do so here in CA., but does that 30 days start from the day THEY filed, which was 10/27/2010, or the day I received the summons, which was the 4th of Nov. 2010?

At first you should call them up and check the proper status of you account. After receiving a summons you have 20-30 days time in your hand, you can negotiate with them and settle the account outside the court. If the settlement offer is not affordable for you, then you can go for a monthly payment plan where you need to pay the full balance in small monthly payments.

Paul, I don't owe this much money and I especially don't owe it to them. They have tacked on over $6,800 dollars more than I owe, so I want to fight it... not give in and be taken advantage of!
Thank you for your answer but it really wasn't the kind of help I was seeking. I was seeking legal recourse to fight this unjust debt.

Before taking any legal action please check the agreement letter, you need to check the interest rate and the late fee charges. Then you can calculate that each month how much they have added towards the balance.

since you stopped making payments to them, they can add the interest and late fees as per the agreement. If it is more than what they suppose to, you can go for a legal action.
