Payday Loan CA Validation Letter
Date: Wed, 11/10/2010 - 07:06
I couldn't find a letter tailored to the collection of payday loans by a third party. I received the Dunning Letter and have now written the Validation letter. I am sending it today certified/return receipt. If you'd like to make suggestions, feel free. Now I already know the payday loan company is illegal so I am just dotting my Is and crossing my Ts.

I am writing in response to your correspondence dated. These letters appear to be identical. Your correspondence appears to indicate you are attempting to collect a debt on behalf of . This letter is to inform you that I would like a validation of the debt and your ability to collect this money from me.
Under the FDCPA, I have the right to request a validation of this debt. I request that you prove that I am indeed the party who is contractually obligated to pay off this debt.
I hope you are aware that reporting any invalidated information to major credit bureaus may constitute defamation of character. In addition, you must also be aware that until you validate this debt, you cannot continue collection activities or report this information to the credit bureaus. Non-compliance with this request may land your company in serious legal trouble with the Federal Trade Commission (FTC) and other state/federal agencies.
Also, under the FDCPA your company may only contact third parties to find out my address, phone number, and where I work. Due to the fact that your company has the afore-mentioned information, your company is prohibited from contacting third parties about this matter.
Please attach copies of the following documents:
