Question on how they calculate the days late

How do they calculate how late you are FOR THEIR PURPOSES. I know that they cannot call you late with the bureaus unitl a full 30 days have lapsed since the due date of your last payment missed. But how do they do it for themselves and charge off status. I am so confused as the last person I spoke with told me that I was only 30 days late..which is true on the reporting end of it...

You have made your last payment on 2nd September, 2010 right? So, you are just 30 days late on your payments. Their calculation starts from the day next to the payment date which you have missed. In your case, the calculation started from 3rd October.
I think the 1st rep with whom you have spoken calculated the date from the last payment which you have made. It actually depends on the creditor.

This is FIA/BOA. I always thought that they would count from the MISSED payment. So I did not make that 10/2 payment or the 11/2 payment. Reporting wise, I am only 30 days late. Come 12/2, I will be behind 60 days. So essentially you are saying that they way they report to the bureau is reality internally as well.
I have been in contact with them and have spoken with them at least 4 times. I do return their calls and talk to them. They went so far as to call my actual home number and my work number. I was very mad. They had my work number from where...I do not know. It is a newer job. SO they are being pretty agressive on their methods I am guessing. I told them NOT to call me at work again and to only call me on the contact number I had given them.
Next time I speak to them, I will see how long it is late and when it will be charged off. Should I Let THEM bring up settling? I have a 401K that I can take a loan on, but I have no money other than that. I am so frustrated and have a big knot in my stomach. I just want to end this. I feel like it has been going on so long, but it hasnt. My hair is starting to fall out..literally. Stress is beyond what I am feeling now.

BOA/FIA has a different method of counting, according to my experience with 4 cards of theirs. Obviously, the logical way to count is to start at your due date, as day zero. But, in reality when I did that I thought I was 90 days late and they told me I was only 60 days late. That, I suspect, is because until you are 30 days late they don't want to admit you are really late. So it seems that their clock may actually start at the 30-day delinquent date. The charge-off clock may start there. Just my experience. You can always ask them but will not necessarily get correct info.
In any event, if you are waiting for 150 days to negotiate, it may actually be closer to 180 days...and so on. I settled $40k at just a touch under 30%. I probably could have done a little better, but they wrote off 70% of my debt AND the additional finance charges and late fees-so I jumped on it. dtm

So I know that you have had dealings with the BOA as you call them. Some questions...
I changed my contact info with them to my cell..then all of a sudden they started calling me at work (one time) and at home. Any ideas how they did that?
Next. They called last night at home (infuriating) and during our conversation told me that at 60 days which is next month, they will send to collections. Right now it is in payments. I pressed them and said what does that mean. He said it would go to an outside company for collections and I dont believe him...he could not explain to me or chose not to. I said there is no way that happens at 60 days...do you mean BOA internal collections and he said no..an outside collection agency...sounds like he is wrong...or could he be right??
