DVL to Patenaude & Felix

I followed information I got here and sent a debt verification request letter to Patenaude & Felix regarding my Amex account. In this letter I asked for 3 things as informed to do so on this site. 1. Agreement with your client that authorizes you to collect the alleged debt. 2. Agreement that bears signiture of the alleged debtor where he promises to pay the original creditor. 3. Complete payment history prooving the amount is accurate. All they sent me was a copy of my most current statement. Are they not required to send me the 3 items that I asked for ? What is the next step I should take ?


Don't cave in on this. No one can say if they will sue you or not. They may have no proof of anything. If they cannot prove the debt to you after your validation later they can't sue you at least not in Missouri and probably in your state.

these people try to intimidate you into paying, they don't even want to have to work for the money, they want you to just hand it over.

DON'T DO IT.

That is exactly right. No one can say what they can prove, no one can say they have anything. I say fight them and you probably won't owe them anything which is exactly what they deserve: NOTHING.

You file your Answer to the complaint/petition they file against you and if you need help filling it out someone here can help you.

If they can't give you the contract then they have nothing and they have to take a hike. Call their bluff.:p

I was sued by AE. They told the Judge they destroy all applications and contracts after 2 years and have nothing to prove I applied for a card. The Judge said I believe you (AE) have a problem. The case was dismissed. They tried again using account stated and account opened with contracts which don't even match the cards. Fight them and there's a great chance you can win.

Remember Statutes of Fraud. They need a contract. However, if you receive a statement from AE, send a DVL immediately. It takes the wind out of their sails and they are left with no real way to prove the debt. Not to mention most Big CC companies like AE, BA, CITI, etc sell their debt as securities and don't even own what they're suing for.

The judge should be dismissing those cases with prejudice so that they could not "try again" until they manage to come up with good enough lies or fraudulent documents or a judge who doesn't care enough to pay attention to what's going on.

They shouldn't be allowed to come back over and over again, hoping this time the defendant won't show or the judge is corrupt. I'm glad it worked out for you though. :D
