Hi have just been reading as much as I can on the forum while I try to figure out what to do. I live in Alabama and right now I have 8 online pdls and 2 storefronts (which I'm not having a problem with) but the onlines are killing me. Every two weeks the fees alone are eating up my check and it seems I have to take out one more just to pay bills. I've tried working extra hours and have cut out buying anything but the basics and still cant get out from under!! I've tried to understand the laws regarding pdls in Ala. which says they are legal but the wording seems to be for storefronts only. For instance it states that loans can only be provided by check cashing facilities only and that intentionally closing your account will result in criminal charges, so is putting a freeze on my account a better option? Some of these I have paid almost the full amount in fees already and have a wave of them hitting by the end of the week. I would like to pay them off but the fees are eating me alive any advice would be helpful. I have loans with the following if you can tell me if they are legal in Ala.

Eastside lenders
LoanPoint USA
Unitedcash
USfast cash
Redstone
Vince Enterprises
Kingston Financial(UK)
CashNetUsa

Thank you again in advance!

Someone will come along shortly and help you determine whether or not these lenders are licensed to do business in your State or not. In the meantime, I would go close my bank account right away so that they cannot get at your paycheck. Also, remember that if these companies are not legal in your State, then you are only responsible for paying back the principal balance and not the interest/fees.

I was thinking of doing that today but I get direct deposit on Wednesday and was worried about closing my account. Also I was concerned about the interpretation of 'check' in the alabama laws-does that include ACH. And I have the two storefronts that I do business with, I cant afford to totally pay them off now (I can renew) but they are holding checks for this account -any advice on how to handle that?

Thanks to all for the advice

True, you don't want to close your account until you have the store front loans paid off due to the pdl laws in your state. What are the names of the store front loans, are they members of the CFSA? If they are members, you could be eligible for an extended payment plan, see the link below to read about the EPP.

I wouldn't focus on the Internet loans right now, I would focus on paying off the store front loans, then you can close your account once you have them paid off. Once you have the store fronts paid off you will need to go obtain a new account elsewhere and close that account. Internet payday lenders are required to be licensed in your state, if they aren't they aren't legal, I suspect most of your online loans are not legal. I have also included a link below of the licensee data base so you can check on these online lenders to see if they are licensed.

If I were you, I would go into the bank, talk to the branch manager (no one else will do) and request a hard debit block be placed on your account, explain that you have been scammed by some Internet payday lenders who are not licensed to lend in your state.
