Has anybody heard of Megan Lundy? She states that she is from Johnson, Freeman frim. She represents ?Paragon bmg group. She states that I took out a loan in june of 09 for 510. That is a wired amount. She states that she is in process of getting a summons. Can she do this. Her contact number is 877-495-3750. I closed the savings account back in 09 because I didn't like the bank. What should I do?

Not a very reputable payday loan company (big surprise lol).

There are laws that this collection firm must comply with (FDCPA), first of all, since they have contacted you via the telephone they MUST send you a letter of collection via the mail within 5 days, that is a federal law, however, they are hoping you don't know that, so the demands they are making over the phone are erroneous.

First rule; NEVER admit to owing a debt to a voice on the phone, simply tell them to send a written collection notice in the mail with the mini miranda warning included, explain that you will not discuss finances over the phone, then hang up. Keep a written record of all communication between you and this collection firm, ask the name of the person calling, the number they are calling from, the address and full name of the firm, ask them to spell it out and write all the information down they give you, as well as the date of the call, content of the conversation, etc. Do this each and every time they call, they will probably hang up or become angry when you begin interrogating them. lol Anyway, the purpose of this is to have as much information as possible because you SHOULD file complaints against them with the FTC, BBB and you Attorney General's office. Protect yourself, know your rights!

They are under no legal and moral obligation to abide by the cease and desist letter and the wage revoke assignment letters. This is why, we always advise to file complaints against these illegal lenders with the authorities like the BBB, the FTC, your states' AG and the financial regulator of your state.

Cease and desist, nah, as far as a wage assignment, it's up to your employer to deny it and why it's important that you inform your employer by providing them a copy of the wage assignment revocation. Read the thread on how to deal with unlicensed lenders, you will have a better understanding of how these illegal lenders work.
