I am being sued in a credit card debt lawsuit and about to get into a second one by dec..
I own a home (well paying for it anyway) and consulted with a lawyer which of course recommended me to file chapt 13 bankruptcy for a $1500 fee.
Because of the ongoing lawsuit is bankruptcy the best option?.
1st hearing suing lawyer did not show but 2nd hearing was made for a monthy from now.
Why is there a default judgement if defendant does not show but yet none of it when plaintiff does not?

Thxs for sharing ideas.

oops never realized anyone had answered.

I have 2 debts in default the first one I am going to court for again tomorrow and I am being threaten by a another debt collector of being sued but just threats for now.

Anyway I decided not to do the bankruptcy for now and just deal with it in court and see what happens,I think the they will ask me to do some payment arrangement with the suing lawyer or he could garner my wages but with the 10% max rule they would not get much really.

My total debt on the first card is about $6,700 and the other maybe $8000 which more than half are fees.I want to repay them but been fighting keeping my mortgage afloat and just recently came out of foreclosure.

Try to get banks to lower loan but to no avail they have no interest in doing so it seems.

lawyer showed up this time though late while i was asking the judge to dismiss the case lol.
Judge asked the suing lawyer how he wanted to proceed who responded that he was not ready for the case and since I pleaded against it the all thing was delayed for another 3 months.

Then I was asked to go talk to that lawyer to see if we could come to an agreement. The all thing was painless really I just got to decide if I fight it in the hope they cannot produce the original contract documents or just start a repayment program since I do owe that debt and hopefully can keep up with payments.
