Wage Assignment

Hello all,

I have been battling my PDL one at a time and this is my last one. The lovely Lakota Cash has sent a wage assignment to my payroll department. Now i had already sent a letter to Lakota to revoke my wage assignemt as well as a copy to my payroll department. They have forwarded the letter to legal and I now await to find out if I will get my whole paycheck this friday. They said they will keep the wage assignment in place until the legal department makes their decision. What are my chances to winning this battle? Is there anything else I should be doing?

It isn't about being right or wrong, it's the law, period. Your employer should already know this, and if they fail to abide by the law by not honoring your wage assignment then they are the ones who will suffer the consequences. Google wage assignments, print out the laws and take it into your employer. They should not be doing anything with it besides denying it.

My payroll received a letter of wage assignment from Lakota. They (Lakota) simply ignored the revoke letter I had emailed them. When I got the letter in the mail yesterday from my payroll dept stating that they have a wage assignment in place beginning this pay period which is friday I immediately faxed them a copy of the revoke letter that I had previously sent them. Their response to me was that they will keep the wage assignment in place but will hold the funds until legal makes a decision. The home office is in another state so I had to remind them of the laws in South Carolina which is a non-garnishment state as well as the voluntary wage assignment can and was revoked. Now I wait and see.

I have just heard back from Legal and they will not be honoring the wage assignment and my pay will be refunded and Lakota Cash will be notified of this action..

Okay...One more quick question...When Lakota gets word that the wage assignment will not be honored what are they going to do? Call and harass is probably all they can do right? They never did call me before the wage assignment..They sent me a letter to make arrangements to pay but thats all I had heard from them until this mess.

What do you think?

Agreed. All they can do is harrass you now and/or sell it to some bottom-feeding collection agency. If they call you themselves, tell them you're done with them (once) and then don't talk to them again. If a CA starts calling, I wouldn't even bother DVing them. I'd just send a C&D. You may also want to let your friends and/or family member know, if you haven't already, that you were a victim of fraud. That way, if they get a call, they can do the same.
