I have a pdl that I stop payment with my account. However the amount is set to withdraw tonight for the full amount. Should I refi just say they take a small amout out. This will force me to sign a contract again, but it will keep them from fully withdrawing the amount until I can get to the bank tomorrow to settle this

Because the withdrawal is in tomorrow and for the full amount, if it we're me I'd refinance and in the morning go straight to my bank and close my account. If this is an illegal lender in your state, I'd file a complaint with the AG, FTC and BBB and provide copies to our PDL. I would revoke any wage assignments tomorrow after you close your bank account and all future correspondence with your lender/lenders do via email, fax or mail so you have a paper trail. If this is an illegal lender you are only obligated to pay back the principle amount of the loan. Perhaps' you have already over paid and should be sending a demand letter requesting a refund and paid in full letter.

It really depends on the state you are in and the name of the pdl. I would hate for you to close your account and refinance without having this information first, each state has different pdl laws. In some states there are very serious consequences for closing your account if there is a post dated check involved.
