Here's my breakdown. All these are internet loans.

Thanks for any help possible
BoA
I did take the letters into the bank. The representative said that you can't revoke ACH authorizations to them because then everyone could just take out payday loans and cancel their authorization without paying it.
It looks like they've let the account open again today so more charges will come out. Why can they not get that? I've told countless people over there that I have revoked ACH withdrawals from that account.
I'm going to call and set up an appointment with a branch manager today and show them the EFT law that you pasted. Maybe it will work, maybe not. I'm going to do as little business with BoA as possible since they are such a pain to work with.
Round 2 with paychecktoday
I sent out reminder emails to all companies with the previous letter (ach revocation, refund demand, settlement info) to all pdl companies again today. Am I still doing things right?
Paycheck today sent the same thing as before:
Yes we are a legal entity. We are a Canadian Tribal entity that is NOT required to be licensed by your state. We have sovereign immunity to state regulations.

So, I responded:
As I stated earlier, I am not a resident of any Canadian Tribe, have never prescribed to be a resident of any Canadian Tribe and have no Canadian Tribe presence, as such I am not subject to the Canadian Tribal laws that you detail. While you may be a ???legal??? entity in your Canadian Tribal region, you are not licensed to lend in any U.S. state that makes you an illegal/unlicensed lender in the state of TN. My state law, TN, prevails over any financial transactions that I enter.

I would file a complaint against BOA to the Federal Reserve System for violating the EFTA law, they can't just trump the federal law to accommodate their self. Seriously, BOA need to be reported.

good point
Good point on BoA. I will do that. I spoke with a friend who used to work with a bank and she said the exact same thing that you have said.
By the way, since paycheck today is being really ugly, I have filed a complaint with the BBB in Tulsa (they have an F score already), the OK attorney general's office, the FTC, and will file with the TN attorney general.
I will definately follow up on the BoA thing. My friend said that I should demand them to return the 4 NSF charges that I had to pay to close my account out.
Thanks Shazzers for your help.
I agree with your friend, they SHOULD refund those NSF charges,
I agree with your friend, they SHOULD refund those NSF charges, they have broken the law by not honoring your request.
Paydayloan yes
Anyone have a US address for this company? I sent the standard letter to them via email 12/28 and again yesterday revoking Ach authorization and requiring contact through email or postal mail only.
Well, I've been getting these strange calls at work at least once a day for the past week or so. Googled the # and guess who it is? Paydayloan yes.
I think that qualifies for an FTC complaint but I think that I need a bit of information about the company to file one. I've seen that they're located in the Bahamas. Don't know if the FTC will take complaints agains a foreign co??
By the way, filed complaints against Paychecktoday with Ok attorney general, BBB, and FTC. Will keep everyone updated on that saga!
