I got a call from someone yesterday from national credit adjusters stating the I have until the 31st of December to pay the 380.00 that I owe for a payday loan. He said that if I dont pay then I will be charged with theft by deception. He also said that he would red flag my social and my drivers license, is that even legal? Are they just using there scare tactics or can they really press charges and sue me? I have every intention of paying this. Help, I dont know what to do!!!

These are just empty threats that this company uses all the time. I wouldn't answer their calls. In the meantime find out if your payday loan company is illegal in your state. If so, you are only liable to pay the amount you borrowed. Then try to make arrangements to pay back that amount. If you've overpaid them and they are illegal, then you owe them nothing, and I would send the collection company a letter to that effect and tell them to cease and desist from all further contact. They most likely will turn it over to another collection agency - then you follow the same procedure.

Good luck.

uh,no national credit adjusters is not legal, and neither is the pdl they are collecting for as they only collect for internet illegals.aubry is right they can do nothing they threaten.no theft was commited, and only your secretary of state can do anything with your license.btw since this was most likely an illegal pdl you only owe the principle, and unless you borrowed 380.00 you don't owe that amount.

Companies like this are shameless; they use all kinds of pseudo-legal terminology to scare people. As an example - what in the world does "red flagging" your drivers' license and social security # mean? It sounds pretty dire but I bet if you'd ask them to explain it, they wouldn't be able to.
