I wouldn't admit to having any knowledge of a debt to a voice on the phone. A 3rd party collector is required by federal law to send the debtor a letter of collection via the mail within 5 days of their first initial contact, that is per the FDCPA.

I tried searching the company in BBB. But the page is not somehow opening. You can search them on Ripoff also. When they call you later, ask them to validate the debt. If they are not able to validate the debt, then send a cease and desist letter to them.

I feel that if you already know that you owe the debt to the original creditor and the original creditor has charged off the account, then it does not make much sense to validate the debt.
The collection agency is contacting you for the payments. It is true that if your name is on the account, then the collection agency can ask you to pay off the dues. You should try and contact your ex-wife and negotiate the matter with her so that she pays off the dues and you do not remain liable for the dues.

I think that they got the message after my second call to them to try and get this resolved they wouldn't say anything other than it doesn't matter what paper work you have you are still responsibe for this debt. I am really not worried about this, but it just bothers me that these people have some of my info and are able to call me ( Three days before X-mass ) and demand that I pay them money. And if this is a vailid claim I would rather pay a lawyer to fight it. I just feel that I have court odered papers that clearly states that my ex has 30 days to take me off all accounts that I was on. I did pay half of the totals on all accounts at the time of the devorce. So i think that any juged would agree and I am willing to take that to court if I have to but I doubt that will happen. If your name is still on the account, you're technically responsible. You will likely have to sue your ex-wife in order to get this resolved.

I really dont think that is the case, if it was than no legal paper work would have value. Not trying to argue with you just doesn't make sence to me. I do understand what you are saying about my name being on the account but all in all i have paper work stating that my name after a certain date (which was eight years ago) is to be removed from from all of this persons accounts it also states that any problems with any of these accounts in the future are the sole responsibility of my ex. If both parties sing this and it is filed by a state court it seems to me that that would superseed any claim from anyone of myself oweing anything on any of my exes accounts. The contract that you signed with the creditor came before the divorce decree. I went through this myself so I know what I'm taliking about. if your ex-wife is not in a position to be abe to qualify for the account being in her name only, you're out of luck. You do have options. You can pay the account yourself and then take her to court to recoup your money. The divorce papers had directives in them, as you said. If she didn't follow those directives, that's on her but, your name is still on that account. If she's not paying it, the creditor will come after you for payment and it's absolutely within their rights to do so. You're right in that she should be responsible, but the creditor won't see it that way. You're likely going to have to take her to court to get this taken care of.
