ook question i am reading all this and i think my mother n i have been treated unfair and dont know what to do!!!! yesterday cach llc had another lawfirm garnish my checking account without noticed or papers we have requested before but no one will help us and now my checking account is froze from a garnishment because my moms name was on my account and they said she had a credit card wchich i have looked and looked and we cant find anything but they sent out a garnishment for her checking account and it is mine with all my money in it they toook every penny with out notice or nothen what should i do?


In order to garnish your savings account, the creditor has to file a lawsuit against you and get a judgment. Unless he gets a judgment, it won't be legal for him to garnish your savings account. If your creditor has done so, have a word with an attorney and check out what legal steps you can take against them.

Contact a lawyer as soon as possible. A good and experienced lawyer can help you get out of this problem. Anna is right. They can't garnish your paycheck or account without securing a judgment order against you from the court. Are you really sure that they haven't secured a judgment order against you? Have you received any court papers regarding this? If you were not served summons or didn't receive any kind of court notice or your creditors didn't obtain a judgment order, then you should file a case against them.

If you read the first post, the OP does not have a judgment against her, her MOTHER does. The mother was sued, not the OP and with any joint account, all the money was fair game.

Have looked up the court case online at your local courthouse? Was your mother served a summons? Did she respond? you do not need an attorney for this. If your mother was not served, you would petion the court to set aside the judgment based on improper service. If your mom did get served and she simply did not respond or show up in court, you are going to be out of luck on your money. Keep in mind that judgement can last up to 20 years depending on what state you live in.
