The Sheriff just delivered a "Summons" to appear in court for a debt with Sears Master Card which at the time "CITI" part of Citicorp of which now Midland Funding LLC is suing for this debt. At this time I am also losing my home and attempting to modify our mortgage loan.
The summons says I have to file my response with the court or lose by default. It also says there may be a legal form available.
The amount was at $10,000.00 when I was no longer to pay and now the summons has a total over $16,000.00. Can anybody give some guidance.

You should contact an experienced lawyer to deal with the situation. You have to appear in the court with all the relevant documents on the specified date. Otherwise, the judgment may go against you. I feel that it will be better for you to go for out of court debt settlement. Contact the customer care department of the collection agency and tell them you want to settle the debt. They may agree to negotiate with you. You can get help from a settlement company in this regard. However, if you have good negotiation skills, then go for do-it-yourself debt settlement.
